A BILL TO BE ENTITLED

1-1 AN ACT

1-2 relating to the minimum base salary for certain licensed peace

1-3 officers.

1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-5 SECTION 1. Chapter 614, Government Code, is amended by

1-6 adding Subchapter F to read as follows:

1-7 SUBCHAPTER F. MINIMUM SALARY FOR CERTAIN LICENSED PEACE OFFICERS

1-8 Sec. 614.081. SALARY SUPPLEMENT FOR CERTAIN LOCAL PEACE

1-9 OFFICERS. (a) A full-time deputy sheriff, deputy constable, or

1-10 municipal police officer who receives an annual base salary paid

1-11 from municipal or county funds of less than $30,000 is entitled to

1-12 a salary supplement from the state in an amount that raises the

1-13 annual base salary to $30,000.

1-14 (B) The governing body of the municipality or the

1-15 commissioners court of the county may not reduce the amount of

1-16 municipal or county funds paid as a salary to a deputy sheriff,

1-17 deputy constable, or municipal police officer in order to use or

1-18 increase the salary supplement provided by this section.

1-19 © If the governing body of a municipality or the

1-20 commissioners court of a county prescribes an annual salary paid

1-21 from municipal or county funds for a full-time deputy sheriff's,

1-22 deputy constable's, or municipal police officer's position in an

1-23 amount that is less than $30,000, the governing body or

1-24 commissioners court may not prescribe a salary paid from municipal

2-1 or county funds for the position in an amount that is less than the

2-2 amount paid by the municipality or county on August 31, 2001, for a

2-3 deputy sheriff's, deputy constable's, or municipal police officer's

2-4 position requiring similar experience and qualifications.

2-5 Sec. 614.082. MINIMUM SALARY FOR DEPARTMENT OF PUBLIC SAFETY

2-6 OFFICERS. A commissioned ranger or other commissioned law

2-7 enforcement officer employed full-time by the Department of Public

2-8 Safety is entitled to receive an annual base salary of not less

2-9 than $30,000.

2-10 SECTION 2. (a) Subject to the amount appropriated for this

2-11 purpose in the General Appropriations Act, a full-time deputy

2-12 sheriff, deputy constable, or municipal police officer paid from

2-13 municipal or county funds who receives an annual base salary of

2-14 less than $30,000 is entitled to receive at least the pro rata

2-15 portion of the salary supplement prescribed by Section 614.081,

2-16 Government Code, as added by this Act, beginning with the first

2-17 full pay period that begins on or after the effective date of this

2-18 Act.

2-19 (B) Subject to the amount appropriated for this purpose in

2-20 the General Appropriations Act, a full-time commissioned ranger or

2-21 other commissioned law enforcement officer employed by the

2-22 Department of Public Safety who receives an annual base salary of

2-23 less than $30,000 is entitled to receive at least the pro rata

2-24 portion of the minimum annual salary prescribed by Section 614.082,

2-25 Government Code, as added by this Act, beginning with the first

2-26 full pay period that begins on or after the effective date of this

2-27 Act.
