Oh Tris,

I am so sorry that you are going through this. These people are

simply a bunch of jackasses!

They have not provided anything but a headache for you, for Colin,

and for all of us (lol).

I don't typically think about taking legal action, so I don't know

how to go about it, or anything like that, but I truly believe

something needs to be done to resolve this to your satisfaction.

Where's Judge Wapner when I need him? LOL Do you already have an

attorney to ask these questions?

Hi Tris -

OH MY GOSH! I can see why you're fuming!! I'm also pretty confused

as to why they never billed your insurance for that one but... if it

works in your favor. To report him possibly go to the AMA .. not

really sure about that one but im sure others here will give you

advice. OHHH, I'd love to pop him one... or ten!

Tris, I didn't figure they would file it with the insurance company

since you paid upfront. Sneaky little devils. Good news (1) is the

ortho (out of town one) has no say on whether he is going to

continue treatment on your son. IDIOT!!! Call Orthomerica

directly, they will have some portion of the blame if they don't

help you. They are the manufacturer of the product that was

faulty. Good news (2)Are you ready for that my attorney's number

now? Work something out? WTF? Like, ummm......let me see if I can

damage your sweet baby's head further? or maybe......Let me see if

I can rip another $1500.00 out of you? or maybe.......Help me keep

my job, come back? Oh, I'm smokin' now! At least the company I

went to, recognized their screw ups. I'm sorry sweetie. What a

Tris,

I have absolutely no experience in these matters, but I wanted to

give you some info you could consider. I would make the owner,

orthotists, and subsitute orthotist aware that you are reporting

this situation to their own organization, the American Academy of

Orthotists and Prosthetists. Let them know that your are aware of

industry news, such as the fact that the AAOP is currently

establishing Clinical Standards of Practice for Orthotic Treatment

of Plagiocephaly this year, as AAOP President Don Katz has

instructed; and that you are submitting your treatment situation

with their business as an example of what needs to be eliminated

when establishing these standards. In addition, you should let them

know that you are aware that the AAOP Craniofacial Society is

presently conducting their survey of orthoses manufacturers and

providers about individual treatment programs, and you will be

sending in this treatment situation you have experienced with them

as an example of an unacceptable one. (Links below:)

information about orthotic treatment programs for this unique

In other words, not having a Starband-trained orthotist available

enough of the time to actually deliver the product results is

unacceptable. Also, referring Starband patients to an orthotist

with no training in cranial orthoses is a dangerous and unacceptable

practice. I would also let them know that you would be composing a

letter to Orthomerica alerting them to this office's Starband

treatment implentation policy and the lack of availability of a

Starband-trained orthotists on the premises to properly monitor

their product.

I don't have any other advice on how to prove that your band never

worked, and you shouldn't pay for it, other than starting a list of

all of the complaints, phone calls, days spent waiting, sub-

orthotist's " handiwork, " etc. I agree that you should document any

discomforts your baby has endured, as well as site the studies

showing earlier treatment yields better results (and you have

suffered lost treatment time.)

I hope they do the appropriate thing, and refund your money, since a

recast or workable situation is impossible with only the one

Starband-trained orthotist only at the facility part-time.

ok well i might tell them you would like to add in the fee for your wasted time, frustration and pain and suffering for your son and if he doesnt get a good correction your sueing them for incompatence i dont even know if you can but damn you should be able to that just burns my ass raw how awful i would have tore them up one side and down the other and grrrr sorry i cant beleive it

Tris,

I have a few choice words for this ortho and the owner. Definitely

call your lawyer also call orthomerica. This is absolutely

unacceptable. They had no idea what they were doing and I really

wouldn't say they provided a service! Hah! He barely wore the thing

because they didn't provide the service you paid for. Did you put

this on your credit card? Call the credit card company. Tell them

you are unhappy and are seeking a refund and want them to withhold

funds or something like that. Also, bring up that the other guy in

the office ruined the band and it can no longer be worn because it

would be in-effective and most likey harmful.

There has got to be such a thing as the better business bureau for

docs??? Please do get an attorney. You can and should get your

money back. This is outragious.. Not only do you and your baby have

a very bad banding experience now this.
