They have not provided anything but a headache for you, for Colin, and for all of us (lol). I don't typically think about taking legal action, so I don't know how to go about it, or anything like that, but I truly believe something needs to be done to resolve this to your satisfaction. Where's Judge Wapner when I need him? LOL Do you already have an attorney to ask these questions? I would make the owner, orthotists, and subsitute orthotist aware that you are reporting this situation to their own organization, the American Academy of Orthotists and Prosthetists. Let them know that your are aware of industry news, such as the fact that the AAOP is currently establishing Clinical Standards of Practice for Orthotic Treatment of Plagiocephaly this year, as AAOP President Don Katz has instructed; and that you are submitting your treatment situation with their business as an example of what needs to be eliminated when establishing these standards. In addition, you should let them know that you are aware that the AAOP Craniofacial Society is presently conducting their survey of orthoses manufacturers and providers about individual treatment programs, and you will be sending in this treatment situation you have experienced with them as an example of an unacceptable one. Also, referring Starband patients to an orthotist with no training in cranial orthoses is a dangerous and unacceptable practice. I would also let them know that you would be composing a letter to Orthomerica alerting them to this office's Starband treatment implentation policy and the lack of availability of a Starband-trained orthotists on the premises to properly monitor their product. I don't have any other advice on how to prove that your band never worked, and you shouldn't pay for it, other than starting a list of all of the complaints, phone calls, days spent waiting, sub- orthotist's " handiwork, " etc. I agree that you should document any discomforts your baby has endured, as well as site the studies showing earlier treatment yields better results (and you have suffered lost treatment time.) I hope they do the appropriate thing, and refund your money, since a recast or workable situation is impossible with only the one Starband-trained orthotist only at the facility part-time. This is absolutely unacceptable. They had no idea what they were doing and I really wouldn't say they provided a service! Hah! He barely wore the thing because they didn't provide the service you paid for. Did you put this on your credit card? Call the credit card company. Tell them you are unhappy and are seeking a refund and want them to withhold funds or something like that. Also, bring up that the other guy in the office ruined the band and it can no longer be worn because it would be in-effective and most likey harmful.
