I am surprised your insurance company has that clause as according to my lawyer self reported symptoms are allowable, the LTD companies just lead you to believe otherwise. However, having said that I remember seeing a show on insurance companies in the US (eg 60 minutes or something like that) and I think they are less regulated than here in Canada -- but don't quote me on that, just a recollection. I am so sorry your case is dragging out so long -- mine was resolved in just over a year after a Discovery and never had to go to court -- I know if I had to go to court it would have taken an extra year or two. Just envision that big windfall you will get when it is settled as I am sure it will be, and hopefully your lawyer will be able to get you more for pain and suffering. You have more than self reported symptoms -- the MRI's and surgeries clearly show where your pain is coming from. I was talking to my lawyer the other day as I have to do a tribunal for my CPP disability in the spring. He suggested I not use him as the only people to benefit is my LTD company and I would be left with a huge legal bill (if I get CPP - Canada Pension Fund - then they just deduct that from my LTD payments and I have to pay tax on it as well). My LTD company also has been bugging me for updated information and did a long phone interview -- reviewing my claim once again -- grrr it never stops! If so, it is a known cause of pain and other issues; plus the fact that even if you aren't retethered, tethered cord is still a known issue for causing retractable pain that is not always alleviated with surgery. Guest guest Posted December 4, 2010 Report Share Posted December 4, 2010 Katharine as i live on the other side of the ocean , I had a perfect job last 6 years, I suppost to go to the ESA in Germany then i faled folowing the German Medical working licence. Same when i got my recommandation for NASA Research in Houston,TX. It was only possible without insurance so the NASA must take care for me if was staing in the US all me life. So i failed the medical test by the US consul. They told also i was not able to work in a normal compagny cause me medical test are almost ZERO. By meself i lost everything. And not only finacial . my girlfriend (car accedent) and i am single from the day she died. I got the feeling North America is going the same way like West Europe do. There where only in the Netherlands 12 cases like LTD in the Netherlands. All lost there 80 - 100% I bin to the high Court myself. I lost. But one week after this Het UWV (LTD) in Netherlands invite me to review. They guy that did the case Put also " Mental Illness " on it. Now they review it every 5 years. And i got it back. One important thing, Docters in the Netherlands NEVER give a MEDICAL CONFIRMATION. Simple They can't , if you have tomorrow a new problem the go to claime the misstake in the Hosptital. You can get only you medical documents youself. If a LDT docter deside not to use this. And write down you have pain withoud a dicribed desease. Ore a other one ( cause he do not know exactly. ) He is always right. by law he did nothing wrong. I diside (wrote this in 2006 on the forum) to go in politics. I did, So this is a job 2006 was also the year i lost my status because they say if you work for the goverment you can do a reguleir job without to ask what work i did. Most people are able to de a callcenterjob. If they can find four sort of jobs jobs you will lost it here. Whe all know some of us have pain whole day. So you stay jobless. It is ofcourse unfair but this is how it works in the Netherlands. You just get money from Social Security. thats it. If you have own money they take it from you , you must eat it (we call it) till you can not pay you rent. the the social money starts I step back in 2007 of the heavy pain. Now i am doing unofficial work for it. My point is as long people have to fill in they own medical papers (cause docter don't do it) Only a qualified MD Neuro Ortho ore where the case is about. Can examinate the patient. Cause a insurance docter has no know-how of al rare illness that exist. And they are working for the LTD so they working on rules. It is a very difficult condition to understand as first it is mostly " invisible " and also, at least in my case, the symptoms can vary so much from day to day that it is impossible to predict. I am so very very grateful for SSDI. I honestly dont know what I would do without it. I was sent papers to fill out a couple days ago as they are " reviewing " my case right now. I had a 3 hour convo @ hospital with Dr Frims resident about how much this condition has robbed us. He said he went back and gave a mini lecture on it, and that has effected him immensely. He promised he would treat every TCP with dignity and their misdiagnosed FOREVER status in mind. He even took me for cake and a smoke at 2am! This is when I was readmitted due to pee issue and was going to (sent home) I hope everyone else takes up spreading the word. I'm so sorry for all of you who have lost so much, I have too. I hope and pray next year is a new beginning for us all I know Chiari has a foundation, what about us? Would everyone like to start one? Yes, spreading the word is the key for all of these rare conditions. As I have been seeing Dr. S about the PN I encourage him to bring as many residents in as possible so that more and more doctors know about these things. But honestly, doesnt it all just boil down to listening and compassion? Being a teaching facility, the residents at OU Med were very attentive and always asked if there was anything they could do for me. I asked them to promise to listen to their patients and have compassion. Regardless of if they know the disease process or what causes it, care enough to listen and do what you can to comfort. Hell, heres a wild concept....get on the internet and learn something new if you dont know about it or help your patient find someone who does know about it...and stop trying to pretend you know about things you dont. I would much prefer a doc to say, Im sorry, I dont know but let me help you find someone that does or let me learn about it. I was a nurse, I know how busy they are, I know there is not enough time in a day to care for everyone but that is their purpose, to help, not to fight us, belittle us, discourage us, ignore us, deny us...meanwhile charging us and sending us into financial ruin.
