Guest guest Posted April 9, 2007 Report Share Posted April 9, 2007 Sharon- I did have a similar thing happen to me, when I was first diagnosed with Stills I applied for Disability not knowing that I wasn't eligible for it because I had started my own business 2 months before my onset. So I was considered self-employed. Well when I applied they gave it to me. I was getting like $700 a month or something like that. Well this went on for months, and one month it stopped. I called to find out why. And I was informed that I was never eligible and that I would now have to pay it all back. I couldn't believe it. The $700 that I was getting wasn't enough as it was and now I had no income and had to pay it back. I wrote a letter explaining why I felt that I shouldn't have to pay the money back. Then I had to go before a panel of judges and plead my case. They listened to my reason, asked me questions and asked if they ruled that I had to pay the money back where would I get it from and I remember I started crying and said I couldn't. My reasoning for not having to pay the money back was that if I didn't think I was eligible I wouldn't of applied, and why did they pay me if I was eligible? It wasn't my fault that their representative messed up, I wouldn't of cashed the checks if I knew I wasn't eligible. Anyway... I got a letter a couple of weeks later saying that they apologize for the stress this has caused me and that they ruled in my favor and that it was their representative that made the mistake. So I didn't have to pay any of the money back. So don't give up, if they gave you the wrong amount of money due to their mess up, then fight it. All the way!! Good luck and keep your head up. I was getting ssdi checks for 640 a month and now they are taking back 200.00 in back money and after that my check will be 500.00. I have also been paying for some of my meds w/ that money!!!! Does anyone have any suggestions? Has anyone had any luck contesting this? 640 was barely enough to pay bills and buy food !!
