Tell them: YOU DO NOT WANT YOUR HEALTH INFORMATION TAKEN WITHOUT CONSENT. NO TO MANDATORY TRACKING OR A REGISTRY AT ANY TIME. THE HEALTH DEPARTMENT SHOULD NOT RECEIVE OR KEEP INFORMATION WITHOUT A PARENT'S KNOWLEDGE OR CONSENT. CHANGING THE REGISTRY TO " OPT-OUT " AT AGE 18 FOR THOSE CHILDREN ALREADY IN IS DISHONEST. SAY NO TO THE CREATION OF AN ADULT REGISTRY BY DEFAULT. In an attempt to once again gain access to all Texans' medical information without their prior knowledge or consent, SB 1186 was amended in the House Public Health committee by Representative Donna , under the guise of disaster preparedness. Our re presentatives are being told this is necessary to receive money under a federal grant program. TELL YOUR ELECTED OFFICIALS YOUR MEDICAL PRIVACY IS NOT FOR SALE ! Make sure you explain that the consent referenced in the bill is a sham. It only determines where information will be stored, not if it will be sent. Consent should be obtained at the provider level, and if it isn't granted, then the information should remain between the patient and provider. This bill creates a mandatory registry in preparation for a POTENTIAL disaster. SB 1186 creates an adult registry by default. The bill allows the health department to keep information on children currently in the registry after they turn 18, until their death, unless they " opt-out " . Those parents that gave consent for their children's information to be included in the registry did so believing it would be removed at age 18. In the event of POTENTIAL disaster or a real on e, this bill fails to acknowledge or recognize people who shouldn't be or don't want to be given an immunization or drug. There are no exemptions. The point of a registry like this is to find and force everyone to use the recommended drugs and vaccines. Federal law allows for the use of experimental immunizations and drugs in the event an emergency is declared. People should have the right to informed consent, and those consenting should be protected from false alarms or unnecessary claims of disaster by a very strict legal definition, not the word POTENTIAL. Products and people causing harm in this situation are completely protected from liability. This bill requires the department by rule to develop guidelines to determine the process by which consent is verified. This means that an unelected bureaucrat, unaccountable to the people of Texas, heading a department with a record of disregarding the law with respect to the use of patient information wil l have total control over consent acquisition and verification. Consent is a sham. The same unelected bureaucrat will be allowed to determine by rule the information contained in the immunization record. All boundaries for what can be taken from the medical record and stored have been removed. We have continued to ask for the same thing from legislators for ten years - no release of information to the department without prior knowledge or consent. It has become clear through the constant incremental erosion of medical privacy that many (both D's and R's) in the legislature have no interest in serving the people of this state where this issue is concerned, only the lobby seems to matter. Not one citizen, without a tie to the medical industry, stood at any of these hearings claiming a need for the state to inject themselves into their private medical records. Not one unencumbered citizen stood there asking the state to sellout medical pri vacy for federal grant money. Not one person claimed to be so full of fear and impending doom that they felt incapable of caring for themselves or their families without the oversight of Big Brother Bureaucracy. Please help send a loud message to our elected officials - STOP SB 1186. Please place your calls and send your letters. Start today and continue through the weekend. They will be working.
