Guest guest
In light of the thread were several parents were commiserating with the lady whose son was kicked out of school because the school won't refer the child for evaluation. . . . . . I found this http://framework.esc18.net/documents/07_Autism.htm which are the TEA definitions of autism. 34 C.F.R. 200.7. Child with a disability. (1)(i)Autism means a developmental disability significantly affecting verbal and nonverbal communication and social interaction, generally evident before age 3, that adversely affects a child's educational performance ++++++++++++++++++++++++++++++++++ My comment: This means, if your son is significantly impaired in his social interactions AND this affects your child's access to the general ed classroom, then they should be referred for evaluation. I'm thinking that the school administrator has not seen this definition and doesn't realize his responsibility. Tonya, do you think that you could load these definitions to the chat group file list. They sure would come in handy at times. Additionally: I found this part under 34 C.F.R. 300.26. Special education. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ 34 C.F.R. 300.26. Special education. (3) Specially-designed instruction means adapting, as appropriate to the needs of an eligible child under this part, the content, methodology, or delivery of instruction-- (i) To address the unique needs of the child that result from the child's disability; and (ii) To ensure access of the child to the general curriculum, so that he or she can meet the educational standards within the jurisdiction of the public agency that apply to all children.
