They had a field trip scheduled for today and his teacher (who is not certified BTW) told me that no one will be staying back to keep him and since they are all going on the field trip that I shouldn't bring him to school and they wouldn't mark him absent. And this is not the first time they've done that. They had me do it before for something they had scheduled and Wednesday they had me pick him up early beacuse of 7th period. Can they do this? Should I be writing to TEA? What are the proper channels to take? I started to raise cane and make them let him come to school, but I thought about it and decided maybe it's better not to because then someone could get mad about staying back and might try to mistreat him, who knows? I know there is a law in place (somewhere) that if I have to keep him at home for them, then I should be compensated. I'm not looking for them to do it, but I just want to give them a run since they want to play hard ball. Then again it would be great if they did. ANy takers? This is a NIGHTMARE. Perhaps you could ask for a teacher's assistant to be his " shadow " to help him. Or you could volunteer to go so that he doesn't miss out on the experience. Guest guest Posted November 17, 2006 Report Share Posted November 17, 2006 Dear kwalk: It is awful that they deprived your son of the field trip, but I've never heard of them asking to keep the child home. If my son missed a field trip because of his behavior, there were always accomodations for him at his school. You can file a complaint with TEA. You can also take them to Due Process. This is all in your Proceedural Safeguards Handbook. Have you looked for an Advocate yet? Have you written your school a letter asking them for an ARD? They have 10 days to comply (from your written notice). Once again, document everything, including what happened today, in an e-mail to your Special Ed Chairperson and Principal of your school. You have got to get a good paper trail going. E-mails will work just fine, because it documents date and time you sent it. You can also legally tape record your telephone conversations with them, without having to let them know they are being tape recorded. This is legal in the State of Texas.
