Forrest Defense - What Happened in Court

The following is a description of what happened in court by :

Hello, all!

I'm happy to report that with the sentencing hearing complete for

the Forrest case, this SAGA seems to be winding down.

Background:

Basically made and sold non-FDA electronic medical devices,

needed to update his website a certain way to do that but did not,

and mostly because of this he was arrested on the Argentina/Paraguay

border and extradited to the U.S. where he's been in jail since

September 24, 2004. His charges included a lot more than just that,

So, what happened at the sentencing hearing?

Here's the short story.

Fined 640$ (540 for reimbursement for the two black boxes they

bought, plus $100 for the plea agreement cost) Given 24 months jail

time, of that he's already served 17 months and may get out 3 months

from now because of good behavior, Given 1 year supervision when

released Here's the longer story: Tuesday 2/21 I found out that

there indeed would be a sentencing hearing on Wed 2/22 (was very

surprised because it had been postponed so many times in the past),

found out that I would be given as much time as I needed to speak on

's behalf, that no one other than me would be speaking on his

behalf, and should work on the premise that the judge had not been

given anything that our group helping had put together. I took 1/2

day vacation time from work and pulled together in one document

everything that I could remember the group had worked on. The

strategy and points Tim Bolen and others came up with helped

tremendously!

Wednesday 2/22 I took a vacation day from work and drove up from

Normal, Illinois to Juneau, Wisconsin (round trip 442 miles). Got up

by 4AM, was there by 8:50AM. The security at the front of the

courthouse building had me take out all the electronic medical

devices I had packed tightly in my backpack - I'd brought a Zapper

(Don Croft), Bob Beck Blood Electrifier (SOTA), Magnetic Pulser

(SOTA), Global Wellness (RIFE) machine - and looked them over

closely, asking me questions about them. I explained what they were

and they seemed slightly interested. Met with Mullins

('s public defense attorney) by 9:15AM. asked me to

speak first when it was defense's time to talk. After talking with

for 5-10 minutes we headed over to the courtroom.

In the courtroom there was the Judge, 2 ladies in front of him who

were probably typing up the proceedings, a man close to the front

who coughed a lot (maybe security?), the prosecuting attorney and

someone sitting with him, Mullins ('s defense

attorney), Forrest, me, and a person sitting behind

and another sitting behind me (2 security people?). The room was

huge, ceilings probably 20 feet high. The acoustics in the room were

not good and although I have very good hearing and was straining to

listen throughout the hearing, I could not hear quite a bit that was

said. said he'd send me a transcript of the proceedings.

The judge talked a little, mentioned he'd received a huge amount of

information from the defense attorney (including a testimonial from

Dr. Haltiwanger) and a large number of testimonials, then

outlined what would happen - Prosecution would speak, then Defense,

then Judge. First the prosecuting attorney spoke. He painted Micheal

to be a scam artist, preying upon the old and sick, making lots of

money for useless products. He talked about 's website that

said his devices cure major diseases like Lupus, Cancer, CFIDS, Gulf

War Syndrome, and others. He said had signed a consent

agreement years before where he agreed to change his website to not

say his devices would cure major diseases and remove testimonials,

but had not complied.

Next, I spoke. I basically said the following:

My name is Charlebois. Im 46 years old; work full-time as a

senior programmer analyst for [a large insurance company], am

married and have two children. I am very curious about alternative

health remedies. I discovered these electronic medical devices

[pointed to my devices I'd spread out on the table] by stumbling

upon an article about Royal Rife which lead to more reading.

Lots and lots of reading books, then yahoo groups (people that

experiment with these devices, from several hundred people to more

than a couple thousand), then movies.

I bought my first electronic device, called a Zapper, about three

years ago, before I ever heard of Forrest. It gave me

several surprising and beneficial results, including getting back to

playing tennis (referred to testimonial I'd brought with copies).

I'd had surgery on the back of my heal over a year before (at the

time), but after going through a month experiment with the zapper

and a colon cleanse product I felt good enough to play tennis again.

I loaned it out to some friends and more than half of them

experienced healing effects. For example, two men hadnt slept thru

the night in years and both were able to sleep soundly straight thru

the night just after the first hour of use. One 28 year-old man had

about twenty warts, some of which he'd had for over 10 years that

his skin doctors could not cure (he tried wart remover, freezing

them off, cutting them out, and other treatments). Basically, after

wearing the Zapper every night for four weeks, they all disappeared

and have not returned. This was 2 years ago.

My results with this Zapper by Hulda (held up the zapper), led

me to try other devices like Bob Becks blood Electrifier (held this

up), a Magnetic Pulser (held it up), and ultimately a Rife-type

machine (held up the Global Wellness machine).

In February of last year, my 86-year old Father-in-law Vern was

diagnosed with prostate cancer. His doctor game him a shot

immediately then recommended radiation therapy as soon as possible.

Instead, Vern took vitamin B-17 and used a Global Wellness RIFE

machine (which is the same box the Energy Wellness Rife Machine

sold, but with a different name) every day. He started July

23 and by mid-October his PSA (Protein Specific Antigen a possible

Prostate Cancer indicator) count was down to 4 - from a high of 70!

Incidentally, Vern is an avid golfer. After two weeks of using the

Rife machine his back pain - which he had had every time he swung a

golf club for three years straight - was gone and he was really

enjoying playing golf three times a week. He also said he felt great

and had a lot more energy. He attributes it all to the machine (as

he calls it).

I became acquainted with just over a year ago because I

wrote him a testimonial (held up copy of my testimonial) to help in

his defense. I hadnt purchased any of the devices he sold, but I did

experiment with some other devices which are made very similar to

the way he makes his but for which he sold at a much lower price.

Your honor, these devices are very inexpensive. Many of them cost

less that a single visit to a medical doctor, and they can be used

for years for pennies worth of electricity. All of these devices

apply tiny amounts of electrical power to a human body in a wide

range of electrical frequencies. This amount of power is far less

than any of the electrical devices that are plugged into the wall of

any household in America.

The electronic medical devices Forrest sold show great promise and

research is proving them to have definite positive therapeutic

effects.

What do we have to support this?

Dr. Haltiwangers (300 + page written) testimony (held up a

copy of the summary report and mentioned should have a copy of

this) Dr. Bares (2-page written) testimony (held up a copy of

this and mentioned should have a copy) Electromed Conferences

sponsored by the United States Air Force (see Tim Bolen for names,

references, CDs and BOXES of research) Rife Conferences (2003, 2004)

hosted by Loyd where hundreds of people attended (including

many health professionals). Many other devices already FDA approved

and very similar (TENS unit, PAP IMI, etc.). The Global Wellness

(RIFE device identical to the Energy Wellness RIFE machine that

sold) has been certified in the European Union and Africa

and Korea.

Since was penniless when I found out about him, the group

that helped gather this information was almost exclusively

volunteer. Why would any of us help on his case if we didnt

know ourselves that the devices work and should be defended? There

are many more interested parties, and people helping by giving

donations or sending testimonials, however the main group consists

of: a. Me - representing consumers interested in seeing these

devices get FDA-approved

b. Several manufacturers of similar devices.

c. Tim Bolen

d. from Germany who runs a RIFE forum

e. Bare who runs another site about RIFE

f. Russ Torlege who sells many instruments similar to Forrest's

g. Three lawyers

h. Several doctors who know these devices work but generally wish to

remain anonymous.

[Many of you who helped I did not mention because either I knew or

thought you'd prefer to remain anonymous. So, forgive me if I didn't

mention you if you would have liked to be among the list.] After a

years correspondence with where we exchanged over a hundred

letters, and having access to s e-mail, I am firmly convinced

that was not out to defraud anyone.

Fraud means a deception deliberately practiced in order to secure

unfair or unlawful gain. Its deliberate. The INTENT is to deceive.

Since Forrest had no intent to deceive there can be no fraud to the

customer. Why do I say Forrest had no intent to deceive his

customers?

Forrest fully believed the devices worked. He had CFIDS (Chronic

Fatigue and Immune Dysfunction Syndrome) for 16 years and cured

himself with his electrotherapy devices. You should have the

testimony by prior girlfriend [name witheld for privacy] to this

effect. He worked for [name witheld for privacy], who ran a health-

food store where worked for over a year. You should have the

testimony by her for s good character and sincere desire to

help people. The price charged for each of his devices was

much lower than the going rate (easily found via internet surfing).

says back when he was charged the first time (by the

FDA/FTC?), all of his customers were (attempted to be) contacted and

asked if they wanted a refund. Of a couple of hundred, only two said

yes. Many testimonies supporting s devices, including this

new one I just received yesterday from [name witheld for privacy],

with approximately 18 people were significantly helped physically

with s devices. The devices worked as he described they were

not just black boxes with flashing lights and wires. We know this

because we hired an independent electronic firm to test 2 of the

devices he sold; one was the Black Box, the other the Magnetic Multi

Pulser. (held up copy of the faxes and said should have a

copy) Proof the Energy Wellness (RIFE) device worked as he

described - we hired another independent electronic firm to test

this device. should have a copy from Jim Folsom/Jim .

There were no customer complaints about 's devices. Devices

like Forrest's are approved for sale and use in several counties in

the European Union. Many hospitals in Europe and Africa use devices

with the same components, output, and operating characteristics as

Forrest's.

Forrest had access to a tremendous amount of information to show

that he had good reason to believe that what he was saying was, and

is now, actually the truth. There is so much legitimate research

material in foreign languages on this subject (Chinese, Japanese,

German, Swedish, Russian, Spanish, Portuguese, etc.) published in

accepted peer review journals, it would take a cart to bring the

data into Court.

Why, then, are these devices not already FDA approved? Because it

costs money to do that. Lots and lots of money.

If there is a great interest in a health treatment, the FDA is

supposed to fund research on it. However, although the interest in

the devices was selling is HUGE, the FDA has not yet funded

research on these. For example:

Four of the 7 devices is being charged with as fraudulent

are RIFE-type devices. I did a search on Royal Rife in

google yesterday and got 16,300 hits. The first 50 hits were all

about this wonderful man, his history and medical devices. Not one

was negative.

One of the 7 devices is a Bob Beck type device. I did a google find

on Bob Beck Protocol, and got about 23,400 hits. 47 of the first 50

were about the Bob Beck I was looking for, and they were all

positive sites sites talking about his protocol and how effective

it is!

Two of the 7 devices are his Magnetic Pulser and Magnetic Multi-

Pulser devices. I did a google find on Magnetic Pulser and got about

10,500 hits. About 45 of the first 50 were information/how

to/testimony sites discussing the benefits of the Magnetic Pulser, 2

were negative, 3 were not about these medical devices. is

concerned with the well-being of others. He has a major altruistic

streak in his personality and made these devices to help people

become healthier despite knowing that there was a good chance that

he would get in trouble for doing so. At great personal risk,

culminating in jail time for over 17 months now, he made these

devices to help others.

Your Honor, since these are Grand Jury Charges, were dealing with

felony charges - the highest form of crime. Therefore there HAS to

be a victim. Yet, I haven't been presented with or seen any evidence

that a victim exists or that any harm has been caused.

Forrest, although guilty of not changing his websites as

required by his prior consent agreement, does not deserve to be in

jail, much less considered a felon. Then spoke. He admitted

breaking the law, said he wouldn't do it again, and would not

encourage others to do civil disobedience. He said he was not

scamming people, that he had a lot of good information that

indicated these devices did positive things, stuff like that. Said

he was only trying to help people. spoke for a short time

( said did not cover some of the information he

expected him to).

After we all finished speaking the judge spoke. He went on for quite

some time. At first he mentioned so many positive things I thought

there might be a chance he would let go and apologize for

arresting him! He mentioned Trudeau and I don't think he

called him a con man! He said how hard it is to get things FDA

approved and that pharmaceutical companies make this process very

difficult, but one must not go around the law. I think he mentioned

the no victim part 2 or 3 times (!!) and think that's why he didn't

include any " restitution " in with the fine. He said that the victim

really was the FDA and also that they needed to protect the people

who may try these devices when they really should be getting medical

help from a doctor. When he said would get 24 months in

jail, it sounded to me like the judge " had " to do that so that

people would not get the mistaken impression that they could evade

the law and not be punished, that had broken the law as he

had admitted and should be punished. And, apparently, if anyone is

sentenced for 24 months in jail they at minimum have to have 1 year

supervision. So, the judge gave him that, too. At the end the judge

asked if there were any questions. The prosecuting attorney asked

something, didn't have any. After it was almost over, the

prosecuting (yes, the prosecuting!) attorney reminded the Judge to

dismiss the other Grand Jury Charges as written up in the Plea

Agreement, which he did.

When and left the courtroom they paused by my table

and said that since had already served 17 months that most

likely he would serve only 3 months more (with time off for good

behavior).
