The Autism Supplement is enforceable and many due process hearings have been had in Texas regarding issues from the supplement. It is part of the Commissioners Rules Governing Special Education in Texas and is just as enforceable as any other state education law. The supplement is, when recommendations are put forth in writing, a mandate (of course, the ARD committee is who determines this in the first place, so it is just as enforceable as anything else in the IEP, because it is a part of the IEP). The original supplement is recommendations to be CONSIDERED, but if they are recommended, it is a part of the IEP just like everything else. Yes, if a parent were to take you to a hearing over staff to student ratio and it had been exceeded based on what is in the autism supplement, the hearing officer would find for the parents. nna Quote Link to comment Share on other sites More sharing options...
