Guest guest Posted October 9, 2006 Report Share Posted October 9, 2006 From the Identified Site Informatin on the Gilbert and Mosley Site, CERCLIS # KSD984969261: " The City of Wichita proposed a plan to address the contamination without being place on the Superfund list to *protect economic development* of the city. The City signed a Steele agreement with KDHE on March 26, 1991 to conduct RI/FS and centian remediation action, which incorporated a *tax increment finance districe* and a certtificate of release program. " There is more about a negociated CAD for " Alternative Clean-up levels " and use of a " permiable reactive barrier " which did not work. More " feasibility studies from 1996 to 1998 (we are up to 7 years later after being kept out of the Superfund liating). Final Design Report was approved (finally) in 2001 (10 years). They discharged the treated groundwater from a perclorate plume directly to the Arkansas River under the approval of KDHE, via a NPDES permit, (using a STORMWATER permit for discharge of treated water???) and transfering (illegally I may add because of the tax incremental financing addition in the original agreement, forgot about that one didn't they) 2 sites into the Dry Cleaners program. That woudl be another funding mechanism taken away from other Kansas Cities and towns, for something that was already paid for!!! Finally there is this statement: " The City filed a lawsuit in 2001 against numerous parties they identified as contributors to the contamination. Many settled with the city; however several including APCO and Reid Supply did not. The City of WIchita is responsible for conductiond *any necessary source contrl actions at facilities where the parties have settled or where a responsible party is not legally responsibel for addressing the contamination. " So there it is in all its corrupt glory: the City of Wichita did must have used that " tax incremental financing " for something else. They have received settlements from most of the RP's.
