Every dairy farming family on the planet and - until very recent times, most people in the world, have consumed absolutely fresh cows milk with great pleasure and great health benefit. With the arrogance of the "science can improve on natural food" fallacy, health authorities in the more backwards parts of the Western World have, only in recent decades, made laws to compel people to consume de-natured dairy products. Wherever, based on the questionable theories of a dead Frenchman, milk is subjected to high temperature (pasteurised) supposedly to make it "safe" for people, real science has identified that changes occur, including :34 critical enzymes are destroyedVitamins are damaged and their bio availability substantially reduced (36 -80 % lost)Minerals, including calcium are depleted or damaged so that the human bodycannot use them properly As a matter of integrity, the parties to this agreement have common cause.A Farmer Pat (Pat McCarthy) cannot, in all honesty supply an inferior product to the good people of Australia, by subjecting his Grade A, first class pure Jersey milk and milk products to the damaging processes the large, foreign owned multi national dairy processors would apply to it before watering it down (with milk from other breeds of cow producing milk with a lot less cream in it) heat treating it and permitting it to be sold when it is way past 'fresh.' B The other party to this agreement is desirous of obtaining for themselves and / or their families, pure, rich, natural fresh milk from Jersey cows with a butterfat content in excess of 4.8 % and does not wish to subject themselves or their loved ones to nutritionally and qualitatively inferior food. As the parties to this Deed of Agreement are both good citizens of this state of Queensland and not wishing to break the law by, as a willing seller and a willing buyer in full knowledge of exactly what they are doing, exchanging some fresh farm produce for currency of the realm as their ancestors were used to doing, they have agreed as set out in this Deed. OPERATIVE PARTThis agreement is Executed and Delivered as a DEED this ………….day of 2002. Farmer Pat will : McCarthy .(hereinafter called "Farmer Pat") of "Meadow Dell" Greenmount via ToowoombaAgrees to sell a share in one of his Jersey dairy cows (a Cowshare) to the Cowshare owner for the sum of five dollars, such cow to then be owned absolutely by a number of such Cowshare owners as Tenants in Common. The number of shares sold and respective rates of contribution to the management of the designated cow subject of this agreement, are to be determined in the absolute discretion of Farmer Pat PROVIDED ALWAYS THAT the number of shares sold in the said cow may not be more than allows of each Tenant in Common receiving an equitable and fair portion of the cow's produce as determined by Farmer Pat. Farmer Pat is to :Manage the Cowshare owner's interest in the said cow to the best of his ability.Make available to the Cowshare owner, on a reasonable basis, such amounts and types of dairy produce as may be agreed between the parties from time to time PROVIDEDan equity and equality of contribution compared to produce taken is maintained as between the respective Tenants in Common in the same designated cow and Farmer Pat is to be the sole and final arbiter of that equity.(ii) establish and maintain a suitable form of administration to ensure that a recordis kept and periodically updated to show :A the designated herd number of the cow subject of this Cowshareagreement, or substituted or replaced from time to time in the herd in the absolute discretion of Farmer Pat.B The paid to date for Management fees paid by the Cowshare owner C The amount in nominal value of produce taken by this Cowshare owner, by right as a Tenant in Common, as compared to the amount/s of produce similarly taken by the other respective Tenants in Common in the same designated cow and compared to the contributions and timely payment of those contributions to management costs contributed by the respective Tenants in common in the same designated cow..Replace, at his own expense, any sick, pregnant, out of production, culled or deceasedcow in which the Cowshare owner has an interest with another cow of suitable attributes and productive capacity.On request of the Cowshare owner party to this Deed, find and introduce a prospective purchaser of the Cowshare to the Cowshare owner and, should those two persons agree on a price to buy and sell, respectively the Cowshare subject of this Agreement and formally advise Farmer Pat, to register in his records the fact of the transfer of interest, negotiate a Management arrangement with the purchaser and provide all the same services (on the same terms and conditions except for quantum of the management contribution) to the new part owner as this Deed provides for the benefit of the previous part owner party to this Deed or another of like effect.
