Of course there would be liability issues, even if (perhaps) not actual liability. If the baby gets sick, the baby's mother is going to automatically assume it's because of something in the donor's milk. If she chooses to sue, the donor mother will have to hire a lawyer to defend herself. She will have expenses even if the judge decides it's a frivolous lawsuit and throws it out (no liability for donor). But if the judge decides the case has merit, then the donor will have additional expenses as the trial progresses. The verdict rendered is the decision as to whether or not the donor has actual liability. But the risk is there. Much safer for donors to donate their milk to a milk bank, where is it pasteurized and pooled with the milk of other donors and it's all anonymous.

Does anyone know if there is any liability issue for a milk donor - the informal donating of milk. There is a woman who contacted me who has a freezer full and has found a mom in need and she wanted to know if there is any liability.

I donated milk to my friend, who was diagnosed with inflammatory breast cancer

in her 3rd trimester. I pumped for a year for her baby. She asked me to get my

blood tested for various nasty things, so I did. Of course my blood was fine. My

friend died 11 days before her baby's first birthday.

If I needed milk, I would ask the prospective donor to get a blood test.

The chances of my baby getting sick for life from industrial milk are so much

higher than the chance of my baby getting anything from a screened donor.

Remember that there is no money involved. Who is going to donate milk then, but

someone that values it and wishes to share?

Maybe our country doesn't understand or appreciate this form of altruism?

Nikki, that was a wonderful thing you did for your friend. I am so sorry that she was not able to see her baby grow up, and I am sure that she appreciated your heartfelt gift.I am not against informal milk donations. I have also donated milk
