Guest guest Posted March 15, 2005 Report Share Posted March 15, 2005 Hey guys, Around the 1st of the month Give or take a few days, I'll be out of pocket. We're Moving! I hate the idea of moving but it will be a good thing. We are having legal problems with the family owned business that is financing our house. We bought through a lease /own purchase. We have been to court 2 times already where the damned idiot has started forclosure on us saying that we weren't paying the payments. Both times we too canceled checks and records from the bank telling whatr was happening and the judges threw it out. This is the third time and we are getting out and then fighting him. He refuses to release the mortgage unless we pay him 5k. We need siding a new roof and about 10 k minimum in improvements. He didn't pay the insurance that was supposed to be paid out of escrow. So after the 20th We won't have home owners unless we pay 800 out of pocket. We can't get a second mortgage for repairs because of the way we financed. After crying all weekend trying to figure out how we were going to pay out of pocket for a new roof, We got a letter that said they were starting the crap all over. Claiming that they needed payments since last june....Now the Judge said we were current as of Oct so they know it is legal record. Tom came home from work and I had the letter and had cried all afternoon. I told Tom right then and there I wanted out of this house. I wanted to live in a house that was not in dire need of repairs. Fixing up a house sounded nice when I was working as a nurse and before the car wreck. Now it's nothing but a pain in the A$$. We started looking. So we signed a lease on a house yesterday. It has siding, 3 bedrooms. 2 baths. nice fenced yard. It's a little more a month, but we figure we can make that up with the savings on the utilities which are killing us here.(Older house poorly insulated. Crappy central unit) It is not my first choice for a house, but the neighborhood is so nice. The house I wanted was on the mountain but still was occupied and wouldn't be ready for a while. So if I disappear for a few days around April 1 don't worry too much. I'll be around. Probably exhausted but here. Now with your wonderful new body, you can make it. You have proved you can do the DS and follow the diet. So anything else is all down hill for you. Just hold onto your resolve and that pretty new red dress. So what if you have to wear it for Easter in a different house. Sad part is one of them contained pitctres we knew we had taken but couldn't figure out what happened to them and the other contained interesting items like my books from when I learned how to fly, some of our son's original " artwork " from K and 1st grade, just little things like that. Thank God you found a house though...and you will be out of that nightmare of court fights and repairs! We are thinking of (actually planning to) re-finance - our house has doubled in value in the last 5 years and we are praying (and have been assured) that we can pay off the second mortgage, the truck, lots of bills, remodel (paint in and out, new floors in the bathroom, new roof, and if I am lucky, pebble-tec flooring!) plus buy a new (used) car and still pay the same or even less than as we are paying now. Saying lots of prayers that it all goes through as we hope it will and we can actually get ahead a little instead of barely scraping by! I can't imagine going through what you are! The stress alone would make me crazy! But having a home where you don't have to worry about being hauled to court will be a BIG relief! Hugs to you.....lots of prayers too!
