IEP related services -- do they have to be provided during school hours?

Due to his OCD, general anxiety, etc. my son has had an IEP for several years.

The only " service " he has been getting is a supplemental class or academic lab

period where a special ed teacher helps with organization, time management,

interfacing with teachers and if need be my son can use his " extra-time " then.

My son benefits by this service & wants to keep it. BUT, as a highly

intellectual, high performing, high-school sophomore, he no longer wants to

sacrifice one of his school periods for this, preferring instead to take a

regular class. His annual review is coming up and we need to make a decision

about next year.

I want to see if the school can provide this service outside normal school hours

(e.g., after school or in the evening). This would meet my son's needs as well

as keep him under an IEP. A by-product of dropping the service would be that he

would be moved to a 504 plan.

Can the school be REQUIRED to provide this service outside normal school hours?
