I'm not sure if you would be able to get a restraining order against a 12 yr old, but I would definitely give the police a call,so they could go and talk to this kids parents, and I would make it clear to the school , that you will not put up with this.( especially since the school is doing nothing and it is THERE job to make sure your son is not being bullied in school) I think that is one of the worst things our kids have to deal with is bullying. they have enough as it is. I know they are children , but I have seen this happen to my little boy too, and I would just like to go out and throttle the kid doing it!!!!! I hope someone has some answers for you. Hang in there! My 12 yr old with OCD had a great summer. Now that school is going again...things are deteriorating. My husband already had to go visit with principal at the high school (Nick moved up to 7th grade) because Nick was being bullied by a kid in band. The same kid who has bullied him for the last 2 years. That of course sets off his OCD. We increased meds from 10mg Lexapro to 20 mg Lexapro this week. Hoping that will buy us some time before we have to switch meds. again. I'm wondering if I should try to file a restraining order against this kid? Is that even possible with a minor? And most of the bullying is verbal...although last week he did hit my son with his drum sticks. Judy, just want you to know I'm praying for you and hope you get some answers and solutions about your son. Guest guest Posted September 14, 2009 Report Share Posted September 14, 2009 I think school policies may vary with regard to bullying and of course the environmental culture (values and beliefs) affect the way bullying is handled. However, I think that there is no way around a school having the liability and responsibility to provide for the safety and welfare of students who attend any school (especially minors). You can call the behavior bullying or criminal, but the school should act. There are laws against harassment, assault, and stalking and I think that these are some of things involved in bullying. Keep a notebook of incidents with dates and action taken. Put the school on notice that if they do not act, you will. That may require you to notify the authorities (police, superintendent) if they do not take action. It sounds harsh, but if the bullying has gone on for that long, I think it needs tough action because it doesn't look like it will end soon enough. Guest guest Posted September 14, 2009 Report Share Posted September 14, 2009 Becky, a quick thought (LOL, " quick " means I haven't thought this through) -- if you are really fed up with the school, call the Office of Civil Rights (OCR). Your son may not be being bullied due to his disability, but I would call and talk to them and tell them that it's making his OCD worse, plus creating an environment he doesn't feel safe in.... They can guide you on your options.
