Los Angeles) I would recommend contacting DSALA as they have a lot of resources to draw from. In my personal experience, Gail on and her staff are genuinely caring and willing to help however they can. Gail is also very prompt at returning phone calls and emails. Their website is dsala.org. I worked as a teacher for LAUSD before my son was born. Our school had some really great staff members who did a wonderful job with Spec. Ed. " stuff. " However, LAUSD is a HUGE school district (2nd after NY?) and can be a nightmare to navigate. If you continue to get shut out at your local school, you may need to start climbing up the food chain. I was told that finally this coming Monday we will get a bus with an a/c. First they said I can't do that then I got the doctors note, then they said that the note was not enough and they wanted a letter and for me to sing the medical release and I told them I would not. So they were more upset and I started sending my son to school because they said they were going to accuse me of I don't know what for holding him at home, so I started timing him on that bus and it ran usually for for over one and a half hour. Well we did not encounter really hot days on those days I was taking data but now I guess they figured what I was trying to do because I told them that the first time around I did not take pictures or had all that detail info but that now I will. Well for whatever reason they had they processed the accommodations, but not only am I happy for my son but his whole class that will benefit from that better ride home and specially since this coming week we will be back into the one hundred degrees or higher. > > So my son officially started school on Sep. 9th I though mostly everything was going to be ok well it was not like always. The school called me and told me that they were going to send a doctor to do a physical exam to my son at school. I was completely shock I did not know things like this happened so I said ok I will be there. She did the exam and said that she needs to talk with my son's pediatrician to make a final decision regarding this bus issue. So I can't get this on my son's IEP unless this doctor justifies it, and that she needs to make sure it is absolutely necessary because it will stay on his IEP until he gets out of the district/graduates. I'm lost once again because all of this is new and I'm not sure on what to say what I can say no to or what I can do different. Specially since things are going to fast I don't what to do. I cannot understand a school district hiring a doc to come to school to examine your xchild. NExt they will want your Medciaid number so they can bill for it! CAll your doc and say that you are rescinding your permission to release info. That you will get the specific things the doc wants from the doc and hand it to her. Just because you have something in an IEP doesn't mean it will be there until they graduate. If that were the case our kids would get SP, OT, PT etc etc until they are 22 and potty training until they are 22. And if it is true she needs this until then we then so it should be in there until she graduates! I think now you may need a good attorney, if they do not approve the air conditioning. When my District demanded that they have me sign to release records, I refused. They have no right! They could not have done a physical without your consent. They can't even give a sports physical without a parent consent. Also, just because something is on an IEP does not mean it stays on an IEP forever. Things come and go off an IEP all the time. Now, if this is a lifelong medical issue, yes, it might stay on the IEP forever because the condition might never improve. I think you need a lawyer and it might mean that you have to take your child to school on your own for awhile. You will be surprised at the money a school will spend to NOT do something when it would cost less to actually just implement a small change. They are trying to set precendence. They dont want to have to do it for everyone. But they will go as far as possible to NOT do things. It mever stops amazing me. The school called me and told me that they were going to send a doctor to do a physical exam to my son at school. I was completely shock I did not know things like this happened so I said ok I will be there. She did the exam and said that she needs to talk with my son's pediatrician to make a final decision regarding this bus issue. So I can't get this on my son's IEP unless this doctor justifies it, and that she needs to make sure it is absolutely necessary because it will stay on his IEP until he gets out of the district/graduates. My daughter and her class were going to shoprite once a week for life skills and for no reason they stopped the whole trip. I fought and fought and only after I sent a email to the mayor, senator, every teacher in the school as well as channel 7 news and the newspaper did it get resolved. I was given so many excuses why they couldn't go but after that email it was back on. I'm very nervous because my son's pediatrician was already frustrated for everything I was asking from him. I'm in the process of going back to Kaiser because I feel like my son's current pediatrician will not be much help in this process with the school, but they will get in contact with him because he was the doctor that wrote the note for the school. This is all on top of the FBA the school is doing, and other reports. My son was under observation and evaluations all day yesterday and I was only able to work 2 hours spent 4 hours at his school. Guest guest Posted October 14, 2011 Report Share Posted October 14, 2011 The reason they say the air conditioning will stay in his IEP until he graduates or leaves the district, is because they know that once something like this gets added, and the child's medical condition is not likely to change, it will be almost impossible to remove it once it is added. The only way they can remove it once it is added, is with your aprroval, or documented medical evidence stating your child no longer needs this adaptation. In court, they will loose, if you protest any decision to remove it. Fight to get it added. Once it is there, all you need to do is get updated letters, when requested, from your doctor, stating there is " no change " , and your child continues to need the air conditioning. If your child has been examined by the school-appointed doctor, without your consent, demand that the full report immediately goes to your child's doctor for review, and also that it not be included for consideration in any review, until your doctor gets the chance to review it, and refute any conflicting statements. If your child has not been examined yet, do not allow it. Tell them " NO " . My child's doctor knows best, and they need to comply with the order given by your child's doctor. Also, immediately (today), call your doctor and tell them to NOT send any documents to the school district. Also, tell your child's doctor about the school doctor. Follow up with a letter to the school district and to your doctor, cancelling any authorizations you may have signed. You will need to rescind your consent right away both by phone and in writing. Take the letter rescinding your consent to the doctors office and have someone sign for it (the receptionist will do) then do the same at your son's school.  A doctor can say " well I've never seen this in my 20 years " that doesn't mean squat!!!! What they are saying is that they are limited in their scope and reference. If you are changing docs let the new doc know what is going on (that you are in dispute with the school about your son's care) and let them know that any previously signed consent to share info has been revoked.  It sounds to me like you have been VERY nice and accommodating to your son's school. If so STOP!!!! It's time to get mean. As in " you will not subject my son to any more poking prodding or testing until this issue is resolved to my satisfaction. You have a medical note, you MUST act on it. It is not optional, it is not up for debate, it is required by law that you comply with a doctors order. Isn & #39;t it funny how some things just can & #39;t be done until you start to document. All of the we can & #39;t just disappears and whatever it was just falls into place.
