It is a documented medical issue that does affect your child's education. Do not accept a review by anyone else, especially by someone who is on the School District payroll, and does not know your daughter's medical needs. Your doctor knows your child. Just send in the letter from your doctor, and demand that they comply immediately. You do not need a new IEP meeting. If they do not comply with your doctor's order, there are very serious issues they can face, legally. If they refuse to comply, after getting the letter from your doctor, demand that they give you the reason why they are refusing to comply with your doctor's orders in writing. If they actually give that to you, then contact your state Dept of Education, and the disability law office, if your state has one. You will get action, and fast. If they refuse to put anything in writing, you can still create a paper trail, for legal purposes. You can write an email to the director of special education, the principal, your child's teacher, the superintendant of schools, and the person in charge of transportation, and send copies to your child's doctor. In this email, you will restate what you believe you were told, and ask for clarification, so that you understand their position. Tell them that if you do not receive a response within 2 business days, you will assume that your understanding is correct. Tell them to respond in writing. Keep doing this after every telephone conversation, or face to face conversation you have about the issue. Keep good notes about " who " , " when " , " where " , and " what " was said. If you are too stressed, or get too confused, which often happens to me, stop the conversation, tell them you do not understand, and tell them to put it in writing. If you do not get it in writing that day, write an email, stating that you did not understand what they were trying to tell you, or that you did not really hear what they were saying, and ask them to write it again, so you will understand...By doing this, they cannot use anything they said to you, legally. Now the school want me to sign a release of information for the school so they can contact the doctor for more information. Now I don't know if this is a good or bad thing. Should I sign something like that? any ideas maybe they are trying to get around for what I'm trying to get my son. Did you speak to the doctor or the nurse? I find that sometimes if you speak to the nurse it gets misinterpreted also. I would speak directly to the doctor stating exactly what you need. You might even write the note yourself and have him just sign it. If he has a specific medical condition with his skin, not a sensitivity, then that needs to be stated. Big words! LOL! Just my opinion but others do this more so they might think otherwise. The school does not need details, just medical orders. As long as the doctor says it is required, medically, the school must comply. You can ask your doctor to put in the temperature that the air conditioner is required for. My child's letter says " Due to medical issues, this child must be in air conditioning any time the temperature exceeds 75 degrees F. This includes the classroom, and transportation. Also, it states that shade, battery operated fans, ice packs, and water must be made available for outdoor activities, and for emergencies such as power failures. " . My child also is allowed to have a water bottle at her desk at all times. Her aide must carry all the other supplies, and carry them to all of her classes. Our school district did not have air conditioned vehicles, and had no air conditioning in the classrooms. Most of the year it is not a problem, but when it is a problem, they have portable air conditioners in every room my child is in, and they had to hire a special transportation company to transport my child. She has this transportation for field trips also, by the way, and she also has a nurse that travels with her to do diaper changes. We won't let aides do diaper changes on a 15 year old. The doctor wrote the letter stating that only a nurse could handle bathroom issues, including diaper changes. There has to be a nurse all day at school now, instead of just a couple of hours a week. They don't like it, and they always try to get it changed, but I don't back down. I do it all the time. Once the doctor's orders are given, they must comply. If a meeting is held, it is only to work out the details on how to comply with the doctor's orders. This can be accomplished by email, and/or telephone if a formal meeting is not called. It is so important, as you mention, to have everything in writing. This is your legal document. You must make sure that document is accurate, and complete. Do not sign it until it is. Some districts will try to get you sign, and promise to make corrections on the " final " document. Don't do it. Tell them to make the corrections, and you will look at that document. Only when it is complete and accurate should you sign it. If you are signing off on an addendum, make sure something isn't removed from the original document before you sign also. (A trick my district likes to pull all the time). When I sign an addendum, I hand-write, after my signature, that this document amends only those areas under consideration, and no other alterations to the original document are approved.(just in case I miss something). Emails are great, because you have proof when you sent something, and they can't say they didn't get it. Unfortunately, not all people are honest, and lying tends to be a disease. I wish that was not true, and you could just trust people, but not these days. Simply state " I'm at work right now, you will need to e-mail me with the details. I will answer you by e-mail when I am not working. " If they push tell them your boss has a problem with you taking personal calls at work. Taking personal calls at work in some places could get a person fired and if they did get you fired they know that you could sue. You might not win, but it would be costly for them. If they have half a brain they will connect the dots between " I can't take personal calls at work " and we could get sued. AND THEN email what you understood from the conversation, sending yourself the copy. You can ask them to stop calling you at work, unless it is an emergency. Ask them to send emails all other times. The paper trail is important. I told her I'm not planning on signing it that and she should just let me know specificaly what she needs and I will get it for her but she said that they still need the paper sign so they can review my son's case. So I called the lawyer I'm still waithing for my call back because I'm stressing too much now I just want to break down and cry. Just tell her to put it in writing. Refuse to engage in conversation that is not backed up in writing. Tell her, " If it isn't in writing, it doesn't count " . Walk away if you have to, but do not sign it. Keep telling them to put in writing exactly what they need, why they need it, and who needs it. Give them your email address. If you are not too stressed later, send an email to the director of special education, and copies to the superintendant of schools, transportation dept, the school nurse, the principal, and your child's teacher.... It should say something like this: *I have heard from the school nurse today, that you will not honor my child's doctor's note regarding the need for air conditioning unless I sign some form, which I am not willing to sign. The nurse stated that you needed this form signed so that someone can " review my child's case " . There is no need for anyone in the district to " review my child's case " . You have the doctor's orders, so please comply immediately.* *If you require additional information in order to comply, please tell me, in writing, exactly what you need, when you need it, why you need it, and who needs to receive this information. * *If I do not receive a response in writing within 2 working days of receipt of this email, I will assume that you have all of the information that you require, and I will need to know the date that you will provide the air conditioning for my child.* *Please do not call me at work or at home. You are perfectly entitled to tell them that you will provide any needed information. You are in fact the parent! This school is obviously used to giving parents the run around in order to get out of doing what is right for the kids. They really have NO right to look at your sons medical records. The nurse can review anything that you provide to her without any signed release. If you have a lawyer available it might be time to get a letter from the lawyer stating that the school district is in violation of IDEA and denying your child a FAPE by refusing to accommodate his medical condition as required by law.  My best recommendation right now though, chocolate, lots and lots of chocolate!!! He basicly told me I was over reacting to this bus thing, and I understand other people would but not my son's doctor. Also said I was asking for too much from him that he is busy and then I need more things. I think that time to look for a new pediatrician is coming up soon ( No one but me and my mom saw how bad he was getting out of that bus I don't think this is a little thing. I feel like something bad could of happen and he can't communicate how he's feeling. Let me add I tried to explain how bad he was getting off the bus and then he said that is normal for some kids????????????? Your best bet is with an office that is connected to a Children's Hospital in your area. Do you have one? If you do, then call the hospital and ask if they have a pediatrician that they can recommend. What if you bring a letter, already written, and just ask your doctor to sign it? Would he be willing to do that? I will help you write it. You can just print it, and ask him to sign it. Under HIPPA, they can read what you give them. NEVER in Jake's 12 years have I ever had to sign a release for our schools to speak to our doctors or have they ever asked to speak to our doctors. HELLLL NOOOOO!!!! Sorry.
