Think about it, entities such as the military & governmental agencies would NOT accept a DPOA if what you described was not allowed. I must add though that IF my mama had been like she was near the end of her life, there probably would have been a problem with how hers was done. Although she understood tnings-she sorta forgot that she had a daughter at times... I am one of those research freaks, so trust me when I say I did my homework on this for her sake. I am glad though it worked out cause I did not want the state (Texas) somehow becoming her guardian. I understand your conflict. It seems so jacked that once our kiddos are 18, we have to become their official guardian or holder of a DPOA & Medical Power of Attorney. I have actually read that unless something is in place, those working with your adult child do not have to even notify you of meetings & such or include the parent...Perhaps, like with my mama, the docs would refuse to discuss care or even current health status without something in place. And I was her next of kin. When I found that out, I hate to say that I got angry & sad. To date there has not been a single teacher or caseworker (invisible caseworker at that) that knows my child.
