Help

Has anyone ever gone to due process? My daughter's never ending IEP

(meeting #5 was on Friday, November 2nd) is scheduled for due process

on Tuesday, November 13th.

I really do not know what to do. Our advocate said that we have a good

chance to get what is needed.

It is in Ashlee's best interest - I am requesting an after school

Tutor - due to the lack of education she received in the past 3 years.

Please advise.

I have never been through a due process. I'm just curious though as

to what kind of education has your daughter had?

Hi Liz,

It's unusual that you would have a date for due process so quickly after your

meeting. I am assuming that that last meeting was a resolution meeting. The

purpose of the meeting was to find common ground and come to an agreement. If

you are asking for compensatory services, Ashlee hasn't received FAPE for the

past three years. Due process requires an extensive brief to be filed with the

state dept stating why she didn't receive FAPE with solid documentation. I am

also assuming that your advocate is an attorney or has expertise in litigation.

Due process is similar to a court hearing. Both sides submit documents and

produce expert witnesses to substantiate their arguments etc. You are not

allowed to testify. I hope you have a good paper trail. You can read about due

idea of the hearings. I wish you good luck. I am also in the process.
