any recourse for vaccine given w/o permission?

A relative just found out that her baby born 2 years ago was given a HepB on the 2nd day of life, even though she had stated in her birth plan and told the nurses not to and gave no permission for it to be given. Does she have any recourse in terms of legal action if the hospital cannot produce their signed consent?
