The school's psychologist is entitled to her opinion but cannot disregard the diagnosis of a medical dr if he has clearly stated in writing that 's primary diagnosis is autism. I would ask the dev ped to clearly write a report defining 's primary diagnosis as autism. You can also request that the dev ped give you a written medical order for ABA. I would request a PPT meeting and present the report defining the primary diagnosis. You then have the legal authority to ask that 's ID be changed to autism. Under federal and state guidelines, IDEA 2004, one label is sufficient. If at that time the school psychologist and the PPT team disregard the medical diagnosis you have legal options to persue the issue further. Getting a medical order for an educational program is a long shot but it may get the services. I have used this strategy in the past when all else has failed and have had good results. If you have the autism label you can appeal to a local autism group to help pair you with another parent, advocate and or autism professional to assist you in the PPT process to get the appropriate services.
