Twice, I have been invited to form private practices with practitioners with licenses other than LCAT; once with a LMHC and most recently with a LCSW.

Can someone please provide the rationale behind the prohibition of LCAT's establishing a business to provide mental health services with a clinician with a different license?

As far as I understand it, I cannot go into private practice with anyone but another LCAT. If that is correct, I'd like to understand the rationale behind this.

If I have that wrong, I'd like to know so that I can pursue the recent invitation to enter a practice with a LCSW. Thanks.

Gretch,This is true...in connection to creating a limited liability partnership (LLP). I don't know details but is easily researched in government sites. This is correct and actually as LCAT 's we must form a PLLC, which stands for Professional LImited Liability Company/Corporation; not a LLC - Limited LIability Company/Corporation. There is a very good mental health lawyer, who also has a psychology degree, on Long Island who can explain all of this. He does offer phone consultations. Hi Gretch - I can't speak to the rationale but it is a law...

Any practice that was formed before June 30, 2004 and has a practice with other

mental health professionals has until July 1, 2014 to dissolve the practice.

(Limited Liavility Company Law Sections 1203 (a). 12-7 (B) and 1301 (a) and;

Partnership Law Sections 121-1500 (q) and 121-1502 (q)).

The NY State corporate law prevents any mental health practitioner from forming

any kind of corporation (PLLC, PC, partnership) with a different license. For

example, and LCSW partnering with an LMFT is also prohibited. Note, this

limitation does not apply to psychologists.

It is an unfortunate law worth re-examination.

Thanks to all who responded. Drena, thanks for the link. I had done quite a bit of reading on the OP site, but had not seen that page before. If anyone has additional info regarding the rationale and/or how the law can be re-examined, I'd appreciate additional direction. It seems ridiculous to me and so unfair.

Suzi, thanks for the referral to Bruce Hillowe. I wonder if he might know more about what's behind this law.

It's hard to stay positive. At the moment, my most promising prospect for work would require 2 hours of driving to provide a 90-minute group. I felt excited and re-energized when the LCSW I so highly respect invited me to set up a practice with her. Following a burst of ideas and conversation, I recalled this regulation and did some more digging. So discouraging.
