Years ago, before my aunt got sick, she put me on her checking account when she was in good health. For the reason I help take care of my grandparents, and she wanted to make sure if she died, that I would have some money. Well what I want to know is my uncle is now her POA, I am her 2nd POA...today he said he was going to see about getting on that checking acct. I know before when she first got sick he tried, and they told him no. But now that he is her POA can he get on that acct? My aunt never put him on it to start with, she put me on it alone for a reason. Now he wants to try, and get on it also so he can write checks on her acct. He went to social security today, because they need someone as POA. Her checks are automatically put in her acct so I am unsure why they need a POA if only it is because they are getting back that refund check in May that President Bush approved...but then my uncle said it could be also for her checking account since her SS goes into that acct. I need your help here, and I can't call the bank it's closed so I want to know if anyone knows out there can he get on that acct even though I am on it with her, because he is her POA? I just don't think he should be able to since I am also the acct holder besides my aunt, and I am alive and well! Any help would be much appreciated! I went down there to do something for my Mom a few weeks ago and they said they don't honor POA's. Is he trying to become her representative payee? Gladys -- Legal banking question need your help?? Guest guest Posted April 4, 2008 Report Share Posted April 4, 2008 I don't think he could get you off of it, but with a financial POA, he has charge of her affairs if your aunt isn't able to take care of them herself, which obviously she isn't. It could be such a thing that you would have to have two signatures on checks, etc., if he were able to get on. Have you seen a copy of the POA so you know what it spells out? It was explained to me when I opened a joint one for Mom and I a few weeks ago, that doing that meant that the money was half hers and half mine. Therefore, he couldn't have authority to sign checks on a joint account even though he has POA because he can't legally have authority over at least 50% of the money in the account. He went to see SS about the check that you have to file to get the rebate check. He told me they needed a POA so I am thinking he meant for that rebate check that is suppose to be coming in May. But then he mentioned our banking acct. she and I have together. If he can get on it without my approval I am going to be upset, I don't think he should when she never had him on it in the first place. But the thing is it is a joint acct. and I can write checks she doesn't have to write also it can be either or. I know he tried a few years ago to get on it, and the bank told him no. She was in very sound mind when her & I went to the bank years ago to open it. I write checks for her out of it now, but I do not touch her money other then that. Guest guest Posted April 4, 2008 Report Share Posted April 4, 2008 Isn't that Rebate Check coming out through the IRS? It will automatically go to all those who filed taxes this year. So, if a tax return was filed for her, there is nothing he has to do. A representative payee is someone who collects your check on your behalf with the intent of using it to care for you. The check will be made out to them instead of to you, but it will say " payee for.... " after their name. I don't think he legally has a right to your joint account. If it was her account and your were listed as POA, then he might be able to get his name added, but he can not have his name added to a joint account without your permission.
