Hi Chelle and

Sorry to butt in, but I've been through LTD and SSD battle. What

happens is that when you are approved for SSD, then the amount that

SSD would of paid you while you were/are receiving LTD is considered

an overpayment on LTD's part and they need to get reimbursed for it.

Just like if you have dependent children under the age of 19 during

the time that you are disabled and they are approved for dependent

disability, LTD considers that to be an overpayment and they can

legally withhold future benefits until that amount is repaid. Even

if the dependent children don't file a claim, LTD would still

considered you to have an overpayment and they can legally withhold

the amount that they would of been paid from your benefits. Anytime

that you are reimbursed for something that was already paid to you by

somone else, you need to pay them back. The Employer pays the

premiums for their employees to have disability benefits and anytime

that an injury or illness is going to last longer than a year

continouly, then the employee is required to file for SSD benefits

and the Disability company does have a right to get reimbursed for

benefits that they paid out when you are approved for SSD. If you

are never approved for SSD, then LTD would continue to pay the same

amount each month.

> As I said in my email to you directly, I don't think you should

talk to LTD anymore, and I think you should not allow them to deal

directly with SSD. If they know you have the money, they could sue

you right away for the $45,000. You could fax them copies of your

current bank statements to show them you don't have it, and then when

you get it, just stop talking to them. But don't give them an

authorization to deal with SSD directly, because then they will know

when you have the money and take steps to get it from you. It sounds

like they want it all, and you haven't posted whether they are even

entitled to it under your policy. DID YOU EVER GET A COPY OF YOUR

POLICY????? I'm going to keep shouting that question at you until I

get an answer. If you don't have the policy, you can't begin to

negotiate anything with them, because you don't know what they were

legally required to do, or what you were legally required to do,

under that policy. Without that knowledge, no one is going to be

able to figure this out. Get a copy right away. Ask that supervisor

when you talk to her again, and don't let her deal directly with

SSD. You may end up losing all of the $49,000 they owe you!

about how harsh it will be if LTD takes the whole amount and you're

left with nothing to pay back your loans, or pay your bills, or get a

car, like you needed to, when the back pay comes. If LTD and SSD

deal with each other directly, and you aren't involved, the money

might just go straight to LTD and you're left completely out of the

loop. The only person who should be dealing with SSD right now is

you or your attorney. Period.
