What happens is that when you are approved for SSD, then the amount that SSD would of paid you while you were/are receiving LTD is considered an overpayment on LTD's part and they need to get reimbursed for it. Just like if you have dependent children under the age of 19 during the time that you are disabled and they are approved for dependent disability, LTD considers that to be an overpayment and they can legally withhold future benefits until that amount is repaid. Even if the dependent children don't file a claim, LTD would still considered you to have an overpayment and they can legally withhold the amount that they would of been paid from your benefits. Anytime that you are reimbursed for something that was already paid to you by somone else, you need to pay them back. The Employer pays the premiums for their employees to have disability benefits and anytime that an injury or illness is going to last longer than a year continouly, then the employee is required to file for SSD benefits and the Disability company does have a right to get reimbursed for benefits that they paid out when you are approved for SSD. If you are never approved for SSD, then LTD would continue to pay the same amount each month. If you don't have the policy, you can't begin to negotiate anything with them, because you don't know what they were legally required to do, or what you were legally required to do, under that policy. Without that knowledge, no one is going to be able to figure this out. Get a copy right away. Ask that supervisor when you talk to her again, and don't let her deal directly with SSD. If LTD and SSD deal with each other directly, and you aren't involved, the money might just go straight to LTD and you're left completely out of the loop.
