Subject: ATTENTION: INSURANCE HEARING TUESDAY

: Attention:

: Tuesday, July 24, 2001 - 9:30 A.M.

:

: The Texas Department of Insurance

: Hobby Building, 333 Guadalupe

: Hearing Room 100

:

: This hearing is worse than we thought.

: It is yet another attempt to exclude MOLD COVERAGE from Homeowners

: Insurance, this time by State Farm Insurance.

:

: Another change would also exclude damage to a foundation caused by slow

: leaks.

: " sudden " leaks causing foundation problems would still be covered. Of

: course who defines a slow leak?

: Reading the following notice the average person would never foresee the

: catastrophic consequence this action can have on millions of Texas

: homeowners.

: Janet Ahmad, President

: HomeOwners for Better Building

: San , TX

:

: *************************************************************************

: **

: The Commissioner of Insurance will consider the

: following matters:

:

: Docket No. 2488: Consideration of the approval of a

: petition filed by State Farm Fire and Casualty

: Company, State Farm General Insurance Company, and

: State Farm Lloyds that requests the adoption of three

: new residential property policy forms which include

: form no. FP-7955 TX (homeowners policy), form no.

: FP-7954 TX (renters policy), and form no. FP-7956 TX

: (condominium unitowners policy) and further requests

: the adoption of thirty-three new endorsements for use

: in the State of Texas. (Reference No. P-0301-04) These

: filings were made pursuant to the Insurance Code

: Article 5.35 (B), which provides that the Commissioner

: may adopt policy forms and endorsements of national

: insurers.

:

: This notification is made pursuant to the Insurance

: Code, Article 5.96, which exempts it from the

: requirements of the Government Code, Chapter 2001

: (Administrative Procedure Act). (HAMILTON)
