The problem with the different types of HCD is not that the states dont accept them, it is that the health care institutions and personnel are so afraid of being sued that they have stated there course of action in this matter in these words, "If the patient does not have a state HCD but rather has one from another source, this may be viewed by the courts as not legally binding , therefore we have no legal standing to accept their wishes and we can be penalized legally for following their wishes, therefore when in doubt as to whether the HCD they have will be upheld in the courts we will take the safe action of resuscitating all persons who do not have a State HCD stating differently". So the problem is they dont want to be dragged into court by relatives stating that the HCD was not a legal document and shouldnt have been followed. The State HCD is recognized as a legal document and protects health care personnel from legal action taken from following the guidelines in it. The health care personnel MAY choose to follow a different HCD but there is no guarantee they will, so I really do not recommend taking the chance. Guest guest Posted October 6, 2006 Report Share Posted October 6, 2006 Peggy, Steve and I are doing a lot better. Things around here are getting a little closer to normal. We went on a much needed vacation to the beach last week and came home rested and tanned. Next week is fall break for our 5 yr old grand De. She will be here for 3 days so we can get lots of hugs and kisses. Then on Friday I will be going to spend the weekend with our 14 yr old grandson Chris. Thank you for asking.
