PT evaluation CCI edit with ER MD E&M code

We are getting a CCI edit that edits our 97001 or 97003 if we evaluate a patient in the ER on the same day that the ER MD charges his 99*** code. We've considered attaching a -59 modifier to our rehab evaluation. Has anyone dealt with this situation? What was your solution?
