Here is a past discussion from a couple years ago on charging for sending records.I have a form my staff fills out to determine the allowed amount to charge.  Locke, MD

Although, interestingly, I don't believe this is a State Law like in

Ohio, but rather a Medical Board " guidance " or directive.

Also, my interpretation is that there is a 2 tier system in Colorado --

a higher fee schedule for non-patient requests and a lower fee for

copying for the patient request.

The new fee schedule applies to insurers, attorneys, and other

individuals or entities requesting copies of a patient's medical

records and allows a reasonable cost not to exceed $16.50 for the first

ten or less pages, 75~ per page for 11- 40 pages, and 50~ per page for

41 pages or more.

There is no change to the fee charged the patient or personal

representative and, as in the past, no fees shall be charged by a

health care provider of patients records for requests for medical

records received from another health care provider or to an individual

regulated pursuant to §25-1-802(1), C.R.S., solely for the purpose of

providing continuing medical care to a patient.

I just received a letter from an attorney

requesting records for my pt who is applying for Social Security

disability.

 

The attorney cites a state (Ohio) law that “a

health care provider…shall provide one copy of the patient’s medical

record WITHOUT CHARGE…to his/her authorized representative if the

records are necessary to support a claim for Social Security

disability.”

 

I’ve always charge the standard $20 fee when

the request came from SSA directly (and they pay it). I’ve never given

records to an attorney for free!! 

 

I realize this may be a quirk in Ohio law

(another reason not to practice here

J), but has anyone else had

this experience?
