95% of all applicants for SSD get denied. You can appeal, or you can hire a lawyer. I got turned down twice or three times, and finally hired a lawyer and requested a hearing during which they declared me disabled. Of course between my first application and the hearing I took Paxil and by the time the hearing rolled around I was completely and utterly deranged, and my doctor said so. This process is not for the faint-hearted, that's for sure.

I didn't know if this should've been on the social board, but I just

wanted to let you know how hard it is to get approved. I was denied

because some doctors didn't turn in their reports and I'm not disabled

enough. They didn't care that I'm always tired, can't concentrate on

tasks and get confused easily, as well as not being able to be too far

from home without panicking. I guess I make a good worker (sarcasm).

I'm still bugging that psych for my medical records, leaving messages

that don't get returned.

I wonder if it would even be worth it to hire a lawyer, one who'd only

bill me if I've won.

It's not like I want to take handouts. I do want to work, but I can't

deal with anything the way I've been feeling. My brain's not focusing

and I can't get it to work right.

There is a difference between SSI (state-funded program) and SSD, which is social security (federal program). It makes a big difference which one you get. The SSI is usually for the poor. SSD is not predicated on how much money you have, only that you are incapable of working. When you are granted SSD, they will tell you when you will be up for a review -- the average time is 2 - 3 years. In my case, they said there was NO hope for recovery and that they would review my case in 5 - 7 years, but it's been 7 years and I haven't had a review.

Thanks Glitter. This helps. I've already spoken to a lawyer so I'll play it by ear.

Hi Glitter,

I'd like to ask a question about Social Security benefits; I'm hoping

you or somebody else can answer. I currently receive SSI (I think it's

SSI; might be SSD...?) and I'm wondering how long can I expect to

continue receiving it? I was lucky because I worked hard at a job for

about 7 years where I paid into the longterm disability insurance, so

when I started having problems and was out longer than the 12 weeks

allowed by the Family and Medical Leave Act, I qualified for longterm

disability payments. So I currently receive LTD plus Social Security.

My longterm benefits need to be re-evaluated by a physician again and

again to determine whether i still qualify for them. (I was lucky

because the company that provides me LTD helped me get the Social

Security award.) Does Social Security work this way, too? Now that I

receive those benefits, I don't want to lose them. I don't feel I will

be well enough to go to work until I am well off the drug, and I have

a ways to go in that department.

** I'm sorry to hear this.

Did the SSD worker also pursue medical records? Did you sign release

forms for them to do this?

Do you recall I gave you that info about HIPAA? I'm sending an official

document separately. It tells you what the law is and what recourse you

have.

How large is this medical provider? Is it a practice of several

physicians or just one?

You'll need to appeal. You don't want to let that time expire. Were you

examined by one of their doctors? Did you ask them what you can do about

physicians who don't comply with record requests?

I don't understand how a determination was so quickly made. I thought

it was May 17 that you did your initial application...?

<<I wonder if it would even be worth it to hire a lawyer, one who'd only

** Well, it would be worth it in the respect that you would get

approved. Why not call a couple and get some info?

** Normally, people are re-evaluated for SSD or SSI annually or every

couple of years. You may find you get re-evaluated though, if your LTD is

discontinued.

Do I recall you saying you presented really well?
