But I get court orders all the time to take child support out of peoples checks at work. Does he have to send the $ to the court, or does the employer take the money out and send it to the court? this doesn't make any sense. Kerri Child support vent/OT As some of you may know, Lou chose to pay me only $744 biweekly for child support despite the court order or $944 biweekly. So I am having it taken straight out of his salary. With back payments that would mean $565 a week, or $1130 biweekly. It took weeks, during which time Lou completely quit paying child support giving himself an interest free loan essentially. He will have to pay all the arrears but in the meantime he got to be a little richer. Finally mid-September I received my first check from the Friend of the Court for $1130. Great. The next one was for $822 and so have all subsequent ones. First I emailed my lawyer and then I realized that it was something I was supposed to check on myself. So I called the Friend of the Court. They agreed that I should be getting $1130 biweekly. So why was I not? " Maybe he isn't working enough hours, " suggested the FOC representative that I spoke with. Huh? An associate professor is a salaried position. He gets the same amount no matter how much or how little he works and since he has tenure he is pretty darn hard to fire. They agreed that he still owed me a considerable arrears, mounting all the time since he never pays full amount and they said they would investigate it. Very slowly, I suspect. I agree. The Friend of Court assured me that he has no say over how much is taken out and figured it was a problem with employer -- they are the ones doing the deducting.
