Hi Shirley,

I applied for medicaid for my husband. It is different for spouses than for a

single person such as; a mother or father that is on medicaid. I saw an Elder

Care Attorney that helped me. I live in California. We had to spend down on some

joint accounts that we had and if they are put into Trusts and Annuities it

protects your assets. The Community Spouse Resource Allowance (CSRA) when I

applied was $95,100. The institutionalized spouse in long-term facility may keep

up to an additional $2,000.00 of countable property. On January 1 of each year

increases are effective.

Medicaid is called, MediCal in California, so I don't know if your laws are a

little different.

I have had a sufficient amount of money to live on. I am only working part time

and I am doing fine. Every year I have to fill out a form of our accounts for

Medicaid in order to keep

my husband on it.

Your Attorney will help you to know what to do. It was very helpful for me to

have the direction of the attorney each step. I made an appointment with a

social worker at the Medicaid office that also helped me get the papers

processed faster after I had spent down on what needed to be spent down on. I

used the money that needed to be spent down on to pay for the first 4 months of

my husband's stay in the nursing home and then after he was in, I applied for

Medicaid and turned it over to Medicaid after it processed through. My attorney

gave me a tip that nursing homes will take out of pocket pay before they take

Medicaid. The other accounts I put into Trusts and Annuities per my attorney's

advice.

My husband charlie is 73 yrs old and has lbd. he's been to the ER

twice in the last week with a stomaach virus and he's really having a

hard time getting around he needs assistance with his walkign and

all. The dr. at the ER asked me if I was going to be able to take

care of him long term or if I needed to put him in a nH. He has 2

sons from another marriage one is disabled due to muscular dystrophy

and the other works he's here with me if I need him when he's off.

Also he has bed sores on each heel and with the diahrea he had for 2

days he has a nasty one on his rear. I took him to his surgeon

yesterday and he asked me the same thing was I going to be able to

take care of him long term. I have a bad back and legs, knees all

due to arthritis that is why i'm out of work on disability. Even

though i " m only 58 I'm not able to lift and help him out of bed.

We have money in a cd and money in savings Do any of you know if i

would be able to transfer this money into my name only and be able to

keep it and him be elegible for medicaid if i need to put him in

one. I read some reports in the links about elder law and it seemed

to state that you could do that but I'm not sure. We live in South

Carolina and I'm planning on seeing an elder att. but was just

wondering if anyone else had gone through this process.thanks Shirley
