Guest guest Posted September 9, 2010 Report Share Posted September 9, 2010 - why is your LTD case taking so long? Mine was resolved this spring with the help of a lawyer. All it took was a discovery and everything was settled. However, I still don't believe I won't have to fight them again down the road. I wish I were wealthy enough not to have to deal with them. Jenn's BF would likely be ok for the first two years, when you just have to prove you cannot do your current job, at the two year mark they try and cut most people off, even if they have a legitimate claim. My lawyer told me there was no real reason my claim was cut off - he suspects it was because I am " young " (45) and they didn't want to pay me for the next 20 years if I didn't get better. And , they lead you to believe that self reported symptoms (eg pain) are not sufficient, but in fact they are. They make money by denying claims as very few people pursue legal action. Will he really want to go through all the pain and rehab (even if all goes well) only to mess it up by lifting again? What surgeon in his right mind would even release him to do so? and last but definately not least.....LTD is NOT stable. I thought they were too, so much in fact that I bought a house as they assured me I would receive benefits as long as I continued to meet their definition of disabled. Then they took it away from me because even though I have operative reports, doctors restrictions, documented nerve damage etc, I cannot prove " pain " . I am still in a lawsuit for this but meanwhile I went without any income until I was able to get SSDI (took over a year). I am still at risk of losing my house because my SSDI is waaaay less than what my LTD was and I am in financial ruin from not being able to pay my bills. Not to mention that I had no health insurance from the time of my loss of employment until I got Medicare (2 year waiting period " after " getting awarded SSDI) My case is going to Federal court next, once I can save up enough money for filing fee's ....LTD is not stable. So, in my BFs mind, that means all will be well. He doesn't want to have to quit his job. He would rather go out on disability (ST or LT - those are stable - guaranteed income from his employer) and have the surgery so that he can return to his job.
