Guest guest Posted August 13, 2012 Report Share Posted August 13, 2012 I agree, is a great resource.However, since I saw your post, I will throw out what I tell my clients. in IDEA there's no hard and fast answer, but best practice dictates that 5 days prior to meeting is a good time to send parents a copy of what they are proposing in order for the parent to have adequate time to review. If parent feels they do not have adequate time, they can always come to the ARD and ask that the ARD be recessed until parent has had time to thoroughly review in order to provide input. Be sure that that is on the record and reflected in the ARD minutes as to wh you are asking for meeting to be recessed. FYI, this is not a disagreement ARD, so do not let them push the parent into signing anything. Guest guest Posted August 13, 2012 Report Share Posted August 13, 2012 I might add that it is common practice in the DFW area for the school to send out the proposed IEP goals 5 school days prior to the ARD. Other paperwork that may be associated with the ARD is usually not sent out since it is created during the ARD. Some districts do provide advance copies of FIEs to parents along with an explanantion from the LSSP/Diagnostician/SLP. I provide advocacy seervices in 18 different ISDs and most of them are using an IEP rogram that allows them to create an electronic version of the ARD meeting, that once completed, is electronically transferred to the District SPED department without generating additional paperwork. The answer is yes. The parent is entitled to have documents prior to the ARD under FERPA (the family educational rights privacy act)and TEA guidance Educational Records • Access and Timelines—You have the right to review your child's entire education record including the parts that are related to special education. If any education record includes information on more than one child, you have the right to inspect and review only the information relating to your child or to be informed of that specific information. You can also give permission for someone else to review your child's record. When you ask to review the records, the school must make them available without unnecessary delay and before any ARD meeting or any due process hearing or resolution session, and in no case more than 45 days after the date of the request. Also you entitled to all records pertaining to the child per Chapter 26 of the Texas Education Code. IDEA mandates that parents are to be equal stakeholders in the development of their child's IEP. This would include access to information that would assist the parent in decision making on behalf of their child. I trust that this helps.
