Guest guest Posted March 11, 1999 Report Share Posted March 11, 1999 I have waited 11 months for social security to rule on my benefits. They have decided that I can work. I was never even sent to a state doctor. I am very upset. Has anyone applied and actually recieved benefits? The doctors I have seen do not know what ACM really is. So what gives these state doctors the right to make these descion. I am 22, I would work if I could. Please give me some encourgement and write in your own experiences. I plan on sending these things with my appeal. So the more stories I have the better. They >have decided that I can work.Hi Jenn, I applied in July for social sec. after my first determination and I was turned down and told that I was able to work, I got a lawyer. A good friend of mine, who is a federal judge in disability told me tthat this is what I needed to do. I asked him if (hypothetical) he saw my application ........would he give it to me. He said NO.......based on what you have told me and what you have written on your app. I would have to get some specialists opinions on the fact of if I could work or not. I would have to prove the fact. The burden is on the applicant...... So.......I hired a lawyer and plan on appealing every wrong determination I may recieve. Be prepared for many form letters to be sent to you. It is really a pain but get a good lawter and let them do the worrying. And to answer your question " Yes " there are many people with chiari who are now drawing it. I am told that only about 1% get it the first go-round. It is very frustrating but, if people hang in there.........they usually come through. Thank so much, > Hi , I have been receiving SS for 8 years. It took two years. I was refused twice and an advocate handled my appeal. The third go round was actually with a judge and there were " neutral " experts to determine my ability to work. It is important that they know that even tho' you can sit, you can't sit long, you can walk, but not for long, etc. any details help their determination. At the time I received disability, I didn't even have a diagnosis of SM. But I had had back surgery and while I knew (and so did they) that it was not causing all my problems, they used it as a diagnosis and I was classified as disabled. I told the judge it was hard to win a race when you had to prove you couldn't. He got it! Don't give up. they are hoping you will do just that. That's why they make it difficult. Survival of the fittest, I guess. Hang in there and get help if you need it. I find it difficult to imagine that any one from Social Security could say that most of us with acm and all the extras can hold down a job. I shall never complain about Social Services here again. We may bitch about the health system over here but thank god we live in Australia.. Countries that have a better economy then us and much larger population seem to have a faulty health care system..... I hope they never completely privatise health care in Australia. Cos I fear if they do, Over servicing will occur... quality of care will faulter. Maybe the Doctors could be made to work in the public system. now and then. so they dont lose touch with thier humanity. *hugs* and love .
