I would just homescool on his level and have him tested if he goes back to public. Most districts try to push them through without meeting the basic 3 requirements. Employable, independent living and future education. If your child is high functioning the placement should be grade level. I just am not happy with enough to get by mentality because he is considered special needs. I keep waiting for a truancy officer to show up with the way to letter sounds.. egh -- You don't raise heroes, you raise sons. My son went to PPCD, homeschooled for Kindergarten, back to public special ed class for 1st, then homeschooled again this year for 2nd. When he went back after K for 1st, they did place him in 1st, though I'm not sure how much the grade designations matter when they are in a self-contained special ed class. With my daughter who is typically developing went into public after being homeschooled for K, they didn't actually give " credit " for homeschooling, but they did require her to be tested to see if she could go in to 1st. She tested OK and was allowed into 1st grade. So, realize they aren't going to give you " credit " for homeschooling, either, but yes, I would fight for him to be in the grade he is supposed to be in. This much I do know is that for starters KINDERGARTEN IS NOT MANDATORY IN TEXAS and then second of all THE DISTRICT CAN NOT HOLD YOUR CHILD BACK WITHOUT YOUR SIGNATURE....These people will blow there smoke all day long but don't back down from them. After an insane weekend of research I sent a certified letter pulling him out of ourSchool and learned by putting him in private or home schooling I could salvage the year so he wouldn't repeat it. We are setting up an interview with creative mind academy and I'm Home schooling for now. It was a long frustrating weekend! The local ISD was not happy and tried everything they could to find out where my son was attending school. they even called some private schools and demanded to know if my son was enrolled there. Yes I had taken them an official letter of withdrawal and they accepted it. I ended up calling the TEA and they advised me that I should send the ISD a Cease and Desist letter which I did do and the phone calls to outside places stopped. Of course I sent it certified return receipt requested. I sent it to the president of the school board, the superintendent of schools and to the principle of the school that my son had attended. Needless to say the phone calls and inquiries stopped very quickly. There is a letter on the TEA web site (I copied and enclosed with my letter) that specifically states that home schools and private schools fall under the exact same compulsory attendance laws and that you do not have to tell the ISD where your child will be attending school, only that you have to officially withdraw them from school. Sometimes they will push you to the brink of Due Process, and only then when they back down. You have to stand your ground. Try to keep the emotions out of it and use concrete supports for your position. Feelings can be dismissed, but data is data. Hang in there. Its a horrible feeling to feel helpless on your childs education and not know what to do! It made me feel like a just fought a kid to go to school an entire year so he would be held back?! what the point! It did validate my want to pull him to go to a private school lord willing if we can afford the tuition or to home school him. Just reminded me the only person who truly can be there to worry about my son and his education is me! We live in one of the best school districts in the state so just didn't expect this I guess.
