It is, and they can't take it away without the further information you are seeking.  Whenever there is an impasse, Stay Put kicks in.  I will try to find it in the federal register for you sometime today.

Stay put comes into play when there is a Placement or programing disagreement.

So If changing his sped. qulifying catagory will also change services or

placements. then until a agreement including IEE to evaluate the proposed

changes is reviewed and acepted then the child's program " stays put " . a few

questions. How would removing the AU catagory change his services or placements.

" make sure to include the 11 stategies for AU. are those looked at under OHI and

SI. and dose he have and OHI and Si in addiotion to hi AU to warent the need for

all three catagories being listed. So If you feel that making sure the IEE is

completed for the AU qualifying catagorie for his sped and related services

would change his placement/services then you would request " in writting " (very

politely) that you want him in his stay put placement (which is his current

pre-change placement until the IEE is completed revirewed and a agreement is

reached.

them removing the au category is not changing his placement or services from I understand. He is staying in the same classroom, same placement, same everything with the additional of ST and additional supports for the OHI-ADHD. Although the 11 additional strategies are not reviewed under ohi and si but we are still doing in home training eval also. The only thing is that the sd did not discuss ESY at all. the ohi and si are new, he only had au up until this point. We just had a 3 year FIE completed and the results said he no longer qualified for au but instead ohi and si. Thus the reason they want to remove au.

Well, it DOES affect his ability to function at school. He is having

a lot of anxiety and he is not able to focus due to the SID. He is

being overly stimulated with sounds and smells. He is not being given

the social training intervention he needs to allow him to feel safe

and secure.

Lorree, I am not even sure he is functioning in his academics as well

as they say he is because I have not seen his IEP, the testing that

has been done on him inside and outside the school, nor all his work.

Lorree, you kept all his work, right?

I'm about fed up with this district and would like to see these things

to see if he is really making progress on his IEP -- I mean REAL

progress.

Make sure you know your rights and your childs rights.

By law they can not do evaluations without your consent.

If you don't agree with even one thing do not sign anything.

Have you had an IEP or ARD meeting lately?

At anytime you feel pressured or need to call a meeting -

do just that. Call for an emergency ARD meeting and the

whole team needs to attend.

Your childs ARD team - parents, every teacher involved

(art, music and PE) does not need to unless thiings are

happening in there. Sped. Dir., Paraproh's, Principal,

SP, OT, PT and everyone who is involved making decisions

to your child's prog.

Recommend: Find a good BCBA/Lic. Psych. to do AN APPROPRIATE full

eval. on the child. Autism Spectrum Assessment Program - ASAP evaluations include both traditional psychological assessments and Behavior Analytic assessments like the ABLLS-R for determining what to do to best serve the child who is found to be in the Autism Spectrum.

We proved to the school system that they did not have an appropriate trained staff for autism

nor an appropriate curriculum design to curtail our sons needs. Our son needed one on one

and data needed to be taken and measured to show our son's progress and more.

Behavioral, academic, social, self help, etc.

Does anyone know why the school system has any say in diagnosing our children. My son has had thourough eval from texas childrens hospital and has complete documentation yet the school just did another eval of their own. When I said cal the SE department, I meant the one at TEA not your district.You need to poll the members one by one to see if they " agree " he doesn't have AU and then you need on tape them saying what their qualifications are for denying him this designation.  They don't have the qualifications.  the school district isn't qualified either.
