Guest guest Posted April 6, 2007 Report Share Posted April 6, 2007 Isn't it funny how each state varies. If I were you I'd check (unless you already have) into the reasonable accommodation thing. If your states Real Estate board uses it-it falls under the discrimination act-I thought all States had to follow the discrimination act) which they have to comply with. Now let me tell you. Alot of them try not too and some of them don't understand that by not complying w/the reasonable accommodations act that they are breaking the law. It is discrimination. If you have an illness and need special reasonable accommodations, if you are willing to pay for the work, or wait for the apartment for reasonable accommodations then they have to comply. There have been many lawsuits around the US by prospective tenants that were discriminated against because they needed reasonable accommodations, even though it didn't fall under the disability act. The disability act is totally different. Not preaching to you. Just want to make sure everyone understands that this is a law, not just a choice the landlord can make. The units I am looking at have carpet. I'd prefer hardwood. However, that would mean I had to take a lower unit which I am not going to do. However, the complex is willing to deduct the price of new carpet and put it toward hardwood floors, or whatever other type I would like. Or, I can just wait for a unit to be vacated and they will install new carpet free of charge. I will pay to have the duct work cleaned which is not very much, also I will purchase and replace the filters every month as I do now. Also, if there is a roof leak my apartment will be the first to get attention. Just remember everyone. Don't fixate on MOLD. Make it about your health and allergens that cause your illness. Pet dander, smoking, cleaning products, things spilled in the carpet that could cause you to stop breathing, or have some other medically documented illness. Don't use the word mold. It scares them off, and they have no intention of accommodating. Heck if you find mold you might go public and tell everyone, ruin their business, which could start lawsuits. They don't want that. There have been several others that have tried these suggestions and have wonderful luck. You could be correct though w/your state. I just thought I remember being told all States w/in the US follow the decimination act. Not trying to boss you or tell you you don't know what you are doing. Just trying to help give not only you but others some food for thought. Or maybe some suggestions they didn't know about. Maybe just some ideas incase they have to face what many of us are. Someone else deciding our IAQ quality is not something I look forward to. But, if I can control it somewhat it will help.
