Wheelchair being held hostage!

Well dang.... Let me think.... if *I* were in that situation..... I would

probably contact medicaid first, and explain that they had paid for this

wheelchair, and what these creeps were doing. And, honestly, I think I'd call

the

police in their area! Maybe she could get an officer to escort her in, and

say that she is there to pick up the wheelchair that is already PAID

FOR....and that if they really believe they have some case against her on the

car

door damage- that they better go on over to small claims court and start

filing~

That is just ridiculous! I hope she gets it settled soon...

Hi Everyone

My daughter-in-law has had a very bad situation and I am wondering if any of

you may have some advice or experience on this.

A few months ago, my dil took my 6yr old grandson Avaryn to be fitted for a

new wheelchair. (he has CMV) While they were in the building being fitted, her

mother sat out with my other grandson (aka Spot) in the car. When they were

finished with the fitting my dil and Avaryn came out of the building (headed for

the car) and the wheelchair fitters came out with her. They claimed that Spot

opened the car door and hit their car and put a hole in their car!

Now, first of all, Spot never left the car. Second he is only 3 yrs old. And,

Third, hitting a car with another car door would not cause a hole! (They

obviously were trying to get someone's insurance to cover damage to their car

and there wasn't even a scratch on my dil's mom's car)

They claimed they had witnesses, but when my dil and her mom asked them to

produce the witnesses they couldn't. My dil's mom said she would not give them

her insurance and they were welcome to call the police if they wanted. They

didn't call the police.

So, finally they went on their way and never really thought about it again.

Yesterday, the wheelchair people called my dil and told her to come to the

office. (this is about an hour's drive from their house) She assumed she was

going to pick up the wheelchair.

When she arrived they told her that they were NOT going to give her the

wheelchair until they got her car insurance information to pay for the hole in

their car! Avaryn is on medicaid with his SSI. We do not know yet if they even

ordered the wheelchair. We do know that if they did, then she can not go to

another place to order another one, because Medicaid has already paid for this

one that they are holding hostage!

I know that this is very illegal what they are doing. I am in so much shock

that anyone would even try to pull something like this! If anyone has ever

experienced anything similar or has any advice, it would be greatly appreciated!

Kristy -

I would call the police and file a police report - there is no reason for

this. If you have a police report at least it is verified - I would have

done it the first time but they thought it was taken care of and I

understand why it was not done - but I would certainly do it now!

I would call the police and have them handle it. The wheelchair has nothing to

do with the car and so they cannot hold that as leverage - this is absolutely

ridiculous.

My first line of action would be to call Medicaid. They will tell you if the

wheelchair has been billed to them. Then explain what happened. Ask Medicaid

what you should do. They will probably advise you to go elsewhere or they will

phone the company and let them know they cannot do this. They may opt to remove

them from receiving medicaid payments in the future.

I had a dentist tell me that they could not see my children on the day we

arrived because medicaid was not paying for the claims previously sent in. They

made me call Medicaid and i was on the phone for 45 minutes pushing this button

and that one and then waiting,. When I finally got a hold of a live person on

the phone, they informed me that the dentist had not sent the claims in with the

" name as it appears on their medicaid cards " . At first Medicaid would not speak

to the third party (dentist), but then when I told them they were refusing to

see my children and I could not afford gas to come at another time until the

claims got paid, they agreed to speak to them. The dentists' office implied all

along that they sent the claim in correctly, but when I inquired as to how they

sent the names in, they sent them in differently than what the cards stated. (My

son has a really long name that does not fit on the card entirely; so, it was

obvious that they had not filed the form correctly.) Medicaid informed me that

they could not deny services and that it was illegal. (Just like they cannot

decline services to you based on a civil matter.) One other option is to call

the local police yourself and have them meet you at the place of business. Tell

them they are keeping an insurance paid wheelchair that belongs to you in lieu

of you providing an insurance card for something you are not at fault for. Once

the police examine the cars, they will soon see that the report they are making

is false and they will tell them this is a civil matter in which they need to

sue you in small claims court. In the meantime, they will HAVE to give you your

wheelchair. (Although, i am not so certain I would want to deal with a company

who behaves in this way.)

Yep, sounds like they need an attorney and a police report. Not fair this

time of the year! Maybe they should make some " SCROOGE! " signs and picket the

wheelchair company. It wouldn't hurt to get some publicity.
