Behavior issues result in broken hip

I would appreciate input please!!

I have a 16 yo son who is autistic/mr/speech problems.

He started having more behavior issues about two years ago shortly after going

into jr high. I asked for help then, but got a simplistic observation report.

His behavior really took off after his contact teacher left. All I got were

calls and notes sent home. I called our 'autism specialist' and asked her to

look into his problems - she didn't do anything that I am aware of. Because the

school was doing nothing, my only option that I knew of was to switch him to a

different jr high his next year. He did a little better, but still getting

calls about his behavior. By the way, I told them I wasn't seeing this behavior

at home!! At his ARD last January I asked, what no BIP??? The reply was, oh

he's not that bad. Went to high school this year and THEY wanted to know how he

got this far withoug a BIP? Good question!! This was at the start of the year

and I was told we would have an ARD to discuss a BIP - I kept asking when??

Well, last month, he fell at school and broke his hip!! The incident report was

skewed to make it look like it was totally his fault because of his behavior - I

saw some red flags - like they left the part out where another kid was sitting

beside him screaming in his ear!! The clinic assistant 'checked him out' and

said he was probably just sore even though he was limping and pointed to his hip

when asked if he was in pain and where! (She didn't tell me that part when she

called me) They sent him home on the bus!! And when I saw the condition he was

in when he got home, I took him straight to the emergency room at the hospital

and yes, now he has 3 screws in his hip! I have looked over both the incident

reports and the clinic reports.

Okay, so I'm thinking IF the school had addressed his behavior issues when I

asked, this would not have happened. They have let the behavior continue

without addressing it so now he thinks it's normal to act up at school.

Was told that my only options were to file a complaint with the TEA as schools

are almost sue proof. My insurance company is going after them as THEY believe

the school is liable for his medical bills (over $20,000!!) There was NO

stepping up and offering to pay - huh, the principal at his high school didn't

even know about it til I called her a month later!!

His annual ARD is coming up in January and I'm loaded for bear - any and all

suggestions will be greatly appreciated!

He is on the GFCF diet and I have and continue to do chelation.
