I would contact a lawyer. If that's out of budget (maybe not for long can you spell monetary damages?) Legal Aid would surely take it. Take a look at that little book that I'm sure most of us have WAY too many copies of. They should not get away with that. Guest guest Posted November 7, 2001 Report Share Posted November 7, 2001 OK I haven't read through all the digests from today and someone may have already addressed this issue by now, of course having an IEP meeting without a parent is illegal. The school is required to give the parent a written notification of an upcoming meeting, the parent is supposed to respond in writing indicating whether they can attend at the time proposed, or request another time. If you did not sign the IEP they have absolutely no authority to implement it. I wouldn't even call the school or the teacher. I would IN WRITING notify the school district that your child's rights have been violated. Explain the situation in detail, citing dates, quoting the people you've talked with at the school, etc. You need a PAPER TRAIL here to protect yourself. But actually if both want to come, I think they must hunt around to find a date that works for all. You have to sign the IEP. This is wrong, wrong, wrong. I would definitely do something about it. Sometimes when you don't object to your legal rights being abused, you can get poorer treatment by a judge because you didn't seem to care. Tell her to CARE visibly, audibly, angrily. It is invalid and against the law to make and IEP without the parents knowledge and consent. She has every right to pitch a royal fit, call for legal help, call the state sped office, and call the local district on to the carpet.
