Guest guest Posted June 13, 2000 Report Share Posted June 13, 2000 My understanding of a " NOEX " warrant is that it is put in NCIC as an officer safety issue. The agency won't extradite outside of their state but there is officer safety caution information (armed,dangerous,etc) that they feel surrounding states should know about if they come into contact with this person. Guest guest Posted June 13, 2000 Report Share Posted June 13, 2000 We advise the officer to secure his mic, then advise him that there is a no extradition warrant for that subject out of ***** for *****. We usually have to emphasize that the officer cannot make an arrest, but just letting them know. It's up to the officer if they tell that person about the warrant. Many times, the officer wants to check on confirmation, anyways. We explain that the no extradition means that they will not transport if arrested so there is no reason to get confirmation. Guest guest Posted June 13, 2000 Report Share Posted June 13, 2000 We ran into a situation several years ago where an agency in our county picked up a subject on a hit, this was back before yq/yr, there was no indicator in the hit that they would not extradite. The subject was detained pending confirmation by this agency, they finally stated they would not extradite. We placed a locate on subject indicated that they would not. Turns out he had just been arrested a couple of days before in Metro Nashville, they had done the same thing as far as NCIC, however when the agency refused to extradite they did not do a locate on him, this left this poor heathern stuck in the NCIC system even after our locate. One of my officers ran an AZ tag while checking a disabled vehicle. It returned as stolen. I notified him immediately and sent back up. A few seconds later he canceled back up and told me the driver was the owner, the tag matched the vehicle and she had proper documentation. She went on to tell him that she had been pulled over at gunpoint 4 times on her way to Ohio. Obviously the agencies that pulled her over were not placing locates on the plate or it would of been canceled already. I sent a hit confirmation and followed up with a phone call explaining the situation. I did place a locate and notified my state control terminal of the situation. I checked the tag until the end of my shift to be sure it was canceled, per LEADS control they told me if it wasn't canceled by the end of my shift they would force the cancel and notify NCIC that the agency in AZ was not canceling confirmed hits. They did cancel it about 4 hours after the hit confirmation and locate. This just serves as a reminder that we need to cancel and update our entries as soon as possible. This poor woman could of been pulled over several more times and it could be a danger not only to her and the officers stopping her but to the general public when back up is responding hot to assist. Also that we need to place locates when we get a confirmed hit, this forces the agency to either honor their pick up radius or take care of the entry or else face the entry being canceled.
