I have a patient who is currently 64 and working and receives LGHP coverage. His wife is on this plan and the patient plans to continue to work until the age of 68. The following questions have been raised:

If he begins dialysis at the age of 64 and applies for Medicare, will the COB period continue?

or

Does Medicare become primary automatically due to his age when he turns 65?

Is his employer, by law, allowed to require him to change his plan to a Medicare plan when he turns 65, even though he continues to be working? If so, what will happen to his wife's coverage?

Hope this makes sense. The patient was told that his LGHP would remain primary whe he turned 65.
