(Register Here $40) SOME OF THE TOPIC INFORMATION INCLUDES: FAMILY EDUCATIONAL RIGHTS AND PRIVACY ACT (FERPA) FERPA was a 1974 amendment to the Federal Elementary and Secondary Education Act which affects all State education agencies as well as all local education agencies. FERPA is at 20 U.S.C. 1232g with regulations at 34 C.F.R. 99. It deals with all children in public school -- it is not a "special education statute -- but it therefore includes all students with special needs. RECORDS ACCESS IN OTHER STATUTES SCHOOL AND STATE EDUCATION AGENCY DUTIES Your school has a duty to provide you with written notice of your rights to access to your child's records. Your State Education Agency also has a duty to provide you with written notice of your rights to access to your child's records. (See 34 C.F.R. 30.561). WHAT SHOULD BE IN THE NOTICE? When the parent inspects and reviews the records The parent can be accompanied by an advocate. The advocate can request access to the records by themselves with the parent's permission. The Parent or advocate can make reasonable requests for explanations and interpretations of the records. The Parent can ask for copies of the records.
