hi there,

I have a question about Tennesse insurance. If a patient has a group health

plan through their employer and they get a new plan through another company,

and there is NO lapse in coverage, can the new policy put them in a

pre-existing clause? thanks for any help anyone can provide!

Keep in mind they may have a transplant waiting period which is separate from the pre-existing waiting period...pre-X may be waived but I've never seen a transplant waiting period get waived....next year in WA State a new law/rule will be in place stating that if the employer changes to a new plan (not the patient's choice to change) they cannot have a new transplant waiting period if the previous transplant waiting period was satisfied.

I believe that if the company has over 50 employees and there is

no lapse in coverage, I have never seen a pre-existing for the employee, and

personally none of my employer coverage has put a pre-existing on any of my

dependants or myself.

Here in Oregon, Regence BCBS of Oregon and Providence Health Plans will waive txp wait period IF the creditable coverage also had a txp benefit of similar scope. The txp benefit wait can be as much as 24 months here, whereas other pre-x are typically 12 months at most.
