Subscription to the list implies consent to the terms. Subscriber Contributions The primary purpose of the 'The Console', 'Console-Talk' and 'The Console' website is to facilitate and foster communication between 911 dispatchers and operators. Subscribers should feel free to express themselves, so long as their contributions comport with community values and comply with applicable laws. Subscribers may not post messages or content that is abusive, defamatory, obscene, fraudulent, in violation of applicable laws, or which could be otherwise offensive or damaging to other subscribers. The list owner reserves the right, without assuming the duty, to remove offensive content and to block any subscriber's access to the list. By contributing to the list, subscribers represent and warrant that they have all of the necessary rights to the use of the information they provide to the list. By subscribing, subscribers grant the list owner the right to display, reproduce, and distribute their contributions in any form, media or technology now known or hereafter developed, including the right to authorize other persons to display, reproduce, and distribute contributions. Subscribers grant and assign any and all rights they may have or acquire in their contributions to the list owner in any and all jurisdictions. The copyright laws of the United States protect the list as a collective work. Subscribers may not reproduce, display, distribute, modify, transmit, or create derivative works from any contribution(s) without the express, written permission of the list owner. Privacy is an important right to many subscribers, and each subscriber has the duty and obligation to respect the privacy rights of other subscribers. By subscribing, you agree not to use or attempt to use any information obtained from the list in any manner which may injure or cause loss to, or may be calculated to injure or cause loss to, either directly or indirectly, any subscriber. Subscribers may reproduce contributions from other subscribers for their own, non-commercial use only. Subscribers may not display, reproduce, distribute, or otherwise use the contributions of other members for any other purpose, and each subscriber has the duty to refrain from any act that would cause any other subscriber harm or any kind, including, but not limited to, the dissemination to non-subscribers of facts, opinions, or information of any kind that any subscriber knows (or reasonably should know) that any other subscriber would wish to keep within the list. In particular, subscribers ! may not publish in any manner the identity or identifying facts (including, but not limited to, the name, location, and/or employer) of any other subscriber, without the express, written permission of both the other subscriber and the list owner. The opinions, facts, advice, information, and other content, which appear on the list, do not necessarily reflect the views of the list owner. The list owner assumes no responsibility or liability for these materials. 2. Indemnification Subscribers agree to indemnify and defend the 'The Console', 'Console-Talk' and 'The Console' website, the list owner, the list's and the list owner's agents, employees and affiliates, from and against all claims, losses, expenses, damages and costs, including reasonable attorney's fees, resulting from (a) any violation of the Terms, and ( any activity (including negligent or wrongful conduct) by you or any other person using the list on your behalf. The moderator reserves the right to assume the exclusive defense and control of any matter subject to indemnification hereunder. 3. Changes to the Terms The moderator reserves the right to change the Terms of the Agreement at any time. Subscribers will receive notification within a reasonable time following any changes. By continuing to subscribe following notice of any such modification, you accept any such modification. Any subscriber who does not agree to any modification must immediately unsubscribe. 4. Limitation of Liability In no event shall the list owner, 'The Console', 'Console-Talk' and 'The Console' website, and employee, agent or affiliate of the list owner or of the 'The Console', 'Console-Talk' and 'The Console' website have any liability for any incidental, consequential or indirect damages arising from the use of, or inability to use, the list, regardless of the cause of action under which such damages are sought, including, without limitation, breach of contract, negligence, or other tort. In the event that any jurisdiction prohibits such an exclusion of warranties or limitation of liability, the liability of the 'The Console', 'Console-Talk' and 'The Console' website, any employee, agent or affiliate of the list owner or of the 'The Console', 'Console-Talk' and 'The Console' website is limited to the greatest extent permitted by the laws of that jurisdiction. 5. Termination The list owner reserves the right to terminate any subscriber's access for any violation of these Terms. The provisions of paragraphs 1 through 4 shall survive the termination of this Agreement. 6. Governing Law This Agreement shall be governed in accordance with the laws of the Commonwealth of Massachusetts, without reference to its conflicts of laws. Subscribers agree that any legal action or proceeding arising from this Agreement shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Massachusetts. 7. Non-Waiver The failure of the list owner or the 'The Console', 'Console-Talk' and 'The Console' website to insist upon strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. 8. Reasonableness " I recognize and agree that the enforcement of this Agreement is necessary to ensure the preservation and continuity of the discussion list, and that the restrictions set forth in this Agreement are reasonable as to time and scope.
