Guest guest
It means go get them! It suggests that Mentor may be willing to negotiate a settlement with you. When I first saw my plastic surgeon about getting implants in April, he told me that today’s Mentor implants didn’t have defective valves, as did the older ones. It must be common knowledge now with the plastic surgeons. Kenda Hi All, Hope everyone is doing okay. I received a report back from Dr. Blais today. If anyone can decipher this I would really appreciate it. I wonder if I have grounds for a lawsuit here. Here goes: Dear Ms. XXXXXXX, Your implants, removed by L.J. Feng on April 13, 2005, were received at Innoval on May 27, 2005. They were examined and remain in our inventory. No destructive tests were performed. Both implants incorporate a faulty valve which do not close because of an intrinsic fabrication defect. The aqueous fluid charge is contaminated with grossly visible particles consistent with microbiological activity. Further, the incompetent valve on the implants allowed periodic leakage of potentially infective fluid into the breast tissue. The capsular tissue reflects significant adverse effects from the implants, most probably through inflammatory and/or infective processes. At the time of writing, users of Mentor implants inserted after 1991 are not comprised in any Class Action. Compensation for injuries arising from Mentor implant-related mishaps are matters of negotiation between the Mentor Corporation and the implant user and/or her legal representative. ETC.... ETC.... Guest guest
Lea and Dawn, I don't think what Dawn posted should cause any problem with a possible law suit. . . It's well known that Mentor produced implants with faulty valves - even after they had been made aware. Why? They need to be asking themselves that. Apparently they don't feel responsible for the health of women who get their implants! Go figure! It's possible that some bright attorney's will decide to take these cases on. . . There are a lot of variables from one state to another. In leu of a class action suit, one needs to check with attorney's in their own state. Of particular note is when the statute of limitations begins! Hugs and prayers to both of you. Guest guest
Hi Rogene, Wish I could find that bright attorney... I'm being turned away already. I'm wondering if this is a stress I should be taking on. I'm depressed already about the fact that I was implanted with a known faulty device, yet I was unaware of it. The report enlightens me as to why I became sick almost immediately. And now I am left with the after effects that may never go away. I had let up some on my detoxing efforts and now have hair loss again. I also developed vitiligo after implantation and I am concerned it may be getting worse. I know that the vitiligo is possibly auto immune related... triggered by the implants most likely. I just hope it doesn't get any worse. Maybe getting back on track with my detox program will hault the progression ... I hope. And here I am coming off of a weekend down at the shore in NJ where I would say 80% of the young girls there have breast implants. I don't hope they get sick... but deep down I wish there were more of something out there in the real world to validate my story. I sat around on the beach with a friend of mine with her enormous plastic breasts that she let hang right out there. Maybe it's me but I could swear she was alittle more discreet about them when I had mine. Now it's like rubbing them in my face. Not that I would risk that road again. Guest guest
Dear Dawn, It's good to see you back! Your health is by far more important than a law suit! .. . . I've seen so many women put so much energy into them, and get so little! Suing is stressful, even if you're not very active yourself. It's something that keeps you in limbo and under stress for a long time. Unfortuately, the only thing that appears to get the attention of the idiots that manufacture, and put implants in place, seems to be the potential for losing their blood money! I wouldn't advise anyone either to sue, or not to sue. I understand! I'm sure Dr. Blais went into the other organisms he found in your implant. I'd suggest talking to your primary care doctor to see if he/she can offer you anything. . . Then, assuming they won't have the answers, or just drugs, I'd suggest seeing a good naturopath. . . Kenda can recommend one who will work with you by phone. Also, I'd recommend Rubin's " The Maker's Diet " . . . He claims that one can turn their health around in 40 days with his program. It certainly couldn't hurt anything (but the checkbook) to try! There are some websites where you can get substantial discounts if that's the route you chose to go! In the meantime, you can submit a MedWatch form, contact your congressmen/women (you may be able to reach them by phone while they're on break), and call the FDA Wednesday . . . I posted info on that the other day. If you need help finding it, let me know. Hugs and prayers, Rogene
Guest guest
Dawn, When I see all those young women with implants, I shudder for their future, and for their children! They have no idea the storm they've unleashed in their bodies! Hugs and prayers, Rogene
Guest guest
Dawn, Manufacturer's sometimes will help you with your medical and surgical expenses without a law suit. . . especially when they know that you know they screwed up! It's a lot cheaper that getting dragged to court! Contacting them may prove beneficial! Hugs, Rogene --- Kenda Skaggs <skaggs@...> wrote: > It means go get them! Guest guest
Interesting! I dont know any PS that would make a statement like that in today's society. I know my PS and the doctors I have always worked for have been very cautious about making ANY statements such as that as they could then be held liable as well in the case of a potential lawsuit. In the nursing profession, WE also have to be very careful about making statements about products such as that. Doctors and/or the PS have no idea what can happen with Mentor products. There are tooooo many problems with them recently for them to say that. Sounds like that PS needs to be enlightened on what is really going on here. Guest guest
The plastic surgeon I saw for a consult did. I was concerned about the valves and other problems in the past and he said that the faulty valves had been corrected. I did try to enlighten him about implants and their health risks when I came back for another appointment and explained why I wouldn’t be getting implants. He didn’t agree and said he would implant any member of his family without hesitation but understood my concerns. I knew then that it was pointless to continue the discussion. His wife is implanted so he probably doesn’t want to know about risks. Kenda Interesting! I dont know any PS that would make a statement like that in today's society. Guest guest
I was told that the percentage of women with problems was very small too but that the problems were capsular contracture and problems with implantation, not autoimmune or health problems. Since he is considered one the best plastic surgeons in my area, of course the risk of problems during surgery would be extremely low. The PS I saw was extremely happy that silicones “would be” back on the market. Kenda Wow! Mine was totally different. Guest guest
Dawn I will have to tell you that I have been down the Atty. road and it was a very long stressful one - didn't amount to anything but getting me upset as i had my hopes up.... I didn't want to get rich- I just wanted enough to cover my explant expenses and other medical needs.... it just caused heartbreak as far as I was concerned... I felt very let down when my case was dropped and it was much more of an emotional roller coaster than I needed mentally and physically... I wish we all could have a case against them to teach them a lesson - it is the LEAST they owe us but for me getting out of worrying about that saved me a lot of heartache. They just do not get it and until they do - and they will, due to the new FDA decision, we are pretty much out of luck in my opinion for lawsuits and it is a waste of time to pursue them unless you can prove gross leg. on your PS. I had proof of that on mine but I was past the "statute of limitations"... didn't matter how much crap was dug up on this guy as long as I was past my 4 years.. it is really sad. They do owe us for their lies for sure but it was much more of a stressor for me that produced absolutely nothing... Just wanted to share that with you - I hope you can find a good atty and get somewhere but please don't let it affect your healing... it did mine and I regret it. love shari
Guest guest
my explanting surgeon actually said he refused to use mentor products when he used to implant as he thought they were not good products due to their failure rates w/ the vales - i can attest to that - I went through three faulty valves shari
