I'm curious when you say " he had a few cases " do you mean he is planning on

proceeding to trial with those cases, or that he is helping a few women

settle thier claims in the Dow Corning bankruptcy? I'm just curious. i know

I've seen several lawyers on the internet willing to take cases for women

who need help with thier claims. But I have not been able to locate any

lawyers that are actually intenting to take any of thier cases to court for

trial though, thats why I am wondering. Thanks, lana

Honey, he took a few cases, but his firm is too small. He took the cases on

a contingency, but because he had no resources to continue he had to put the

women into the class action here in Canada. He will continue to represent

them, but only through the class action.

My lawyer is willing to take my case to trial if he has to. He is with a

large firm here, and he has the resources to take my case all the way to the

Supreme Court of Canada. He will not take any other clients at this point.

Lana, I think that lawyers feel that the breast implant crisis is over and

that we have all been taken care of. The Dow Corning Bankruptcy is a joke,

many women will never see a cent. It is the same here in Canada, most of the

women have to settle for $4,000. 00 or less. We need to educate as many

lawyers as we can, I know that I will never stop knocking on lawyers doors.

I've been through a rather lenghty grueling UGLY trial with the manufactures

before and because they have unlimited access to so many expert wittnesses

,which are paid close to, if not more than $500,000 to $750,000 per

wittneses per trial it's VERY difficult and very expensive to try these

cases. The Federal court judge also restricted plaintiffs from calling

manufactures executives as wittnesses. Each case has to relay on and reuse

the same deposition and testimonies for the first trials that were done in

the early ninties. Then the Fedreal courts in Alabama restricted all of the

cases to local injuries only, that took away the majority of compensations

that would have been and should have been dealt with. Along with that most

states have cap of 250,000 and or no punitive damages at all. Damages that

where origanily designed to help injured claiments with past and on going

exspenses related to their injuries. Then to top it all off in most states

the manufactures have a BLANKET OF PROTECTION that keeps you from being able

to sue them. And last but not least you have in adiquite testing and

unreasonable statuses of limitations to deal with. The implants worse

problems don't manifiest themselves in the amount of time offered by the

courts to actually sue for damages because they haven't presented them

selves yet. This whole thing is discusting and I pray for ALL of those

involved. lana

Dearest Beth:

Our friend said that you do have a case in the US, but if you lived in Canada you would not. It is called Spoliation of Evidence,(look this up on the internet) but could you find a lawyer to take a case like this? He loved your note, his wife thought it was sweet. She said he is mine now and forever. She is a lovely lady, I'm sure that we will become friends.

We have just come in from a very early dinner and the heat in the restaurant nearly killed me. Our friends are gone and I'm going to bed, it has been a long day for me. We plan to watch Brockivich tonight, bought the movie. Perhaps this will make me angry, I do my best work when I'm angry.

Honey, I wish you all the luck in the world. When I was explanted and everything was destroyed I would have had a good case....but I live in Canada. Plastic surgeons should be warned about this, and perhaps they would think first before they destroy any evidence....love you....Lea
