A toxicologist does environmental sampling, reviews files, esp medical

files, MSDS sheets, labels, other expert's sampling data, scientific

literature..............

and then does a tox evaluation on the victim(s) to establish temporal and

spatial correlations between exposure and the development of acute and/or

chronic symptoms consistent with the exposure.............and then testifies

in court as an expert witness as to whether or not the symptoms are

consistent with the exposure to that particular chemical.

I have handled about 900 cases since 1976 and have been a professor at

the Univ of Florida teaching toxicology and currently teach tox/OSHA HazMat

at the Univ of North Fla. I consult on about 100 new cases a year all over

My most important job is to do the " worst case " kind of sampling in homes

and offices to get the needed lab proof of exposure and then to set-up exams

with labs and MD's to get the needed clinical proof of injury from toxic

encephalopathy, liver enzyme effects, PFT effects, immunotox effects all the

way down to cognitive deficits from a neuro-psych exam. The " Associates " in

LIPSEY & Assoc. are MD's and PhD's who are tops in their fields, ie Dr. Tom

Callender, Dr. Kaye Killburn, Dr. Alan Lieberman, Dr. Ray Singer, Dr. Jack

Thrasher, etc. I work with some of the finest toxic tort attys in the US. The

judgments and settlements, where I have been the expert witness in

toxicology, have produced from $20 million, to $10 million (Nashville-vs

Terminex RE: MCS) to $5.7 million (formaldehyde/cancer of the throat), to

$3.7 million to " Tens of Millions " (Dow Chem./Dursban crippling of a

child-Atty Callwell, Chas, WVA), etc. A few have lost their lawsuits for

various reasons.

I hope this information will be useful to you. Most toxicologist

consulting for chem companies appear to be pharmacologist,ie prescription

drugs where their are fewer lawsuits so they have moved into pest control

accidents, carbon monoxide, formaldehyde, etc. A good MD, good toxicologist

and esp a good attorney at essential to a successful case.

I asked my Internist back in 1993 if I shouldn't go to a toxicologist! He

said I was nuts and sent me to a 'shrink.' I didn't know I had Porphyria or

MCS - but I knew I WAS being poisoned by something! As it turned out, I

was right on target! It's a good thing I got laid off back in 1992 or I

might not be here to write this!

I have also had Dr. Lipsey in my home to do testing. I think he did an

excellent job and certinally knows is buisness. I do not want to get

invilved with the controversy that is going on with people downing him.

He in my books knows his work and I felt very confident in his testing

of our home.

He has been handeling cases for my attorney and I think they think

highly of him. If any one has any bad comments they should not be

mouthing off on line and make a fool of themselves.

I cannot believe that anyone would use this form to bash Dr.

Lipsey. He has served as an expert witness for me and always does a

credible and excellent job.

What is wrong with posting a simple message about your activities.

I think if any one has any thing bad to say about Dr.LIpsey.........KEEP

IT TO YOURSELVES.......This group is supposed to stick together and help

one another .....and let us keep it that way.

We need each other for support and that is what I thought this group was

all about

Funny. I thought this list was supposed to be about

information, not blind " support. " When it is suggested

that a practitioner may be violating state and federal

laws (by doing unlicensed asbestos sampling), that is

a serious matter that deserves serious consideration

and a serious response. No matter how wonderful and

knowledgeable a person might be, the law is still the

law.
