I would file a state complaint for an illegal IEP meeting, geeeesh what a

waste of time huh??? maybe if compliant monitors came to visit they'd be a

bit more polite

Exactly! I think that is what I would say in my letter, " now that we have

had a pre-IEP conference, when will the meeting take place with the

administrator and regular ed teacher the law requires? " ;-)

Dana, Did you get an explination about what happened

to them? I know I would have been very discouraged and

angry also. Did you go to the principle? I always am a

little tense as these things come up even though they

have been fine.I know I usually have 4 to 6 people at

the iep. Pam

Hi!

I'd be pretty pissed too. Was everything covered at the IEP that needed

covered? Were there any areas of disagreement? Thinking about it,

agreement or not, I would ask for another meeting. They are supposed to

review proggress, goals and methods. Clearly, this did not happen.

It also sounds like the IEP was written before you ever got there. This

is o.k. if it is done as a draft but, if no one shows up thus preventing

the opportunnitty for discussion of the goals and methods, then in effect

what they handed you was the fianl copy.

I would write a strongly worded yet diplomatic letter expressing your

disapointment that your child was not enough of a prioirty for them to

attend the meeting and to let thewm know that you value the " team "

proccess which is supposed to be at the heart of an IEP meeting and that

you do not expect such a thing to happen again. Remeber, " Diplomatic " :-)

Dana, That was illegal!! Write a letter addressed to the principal of the

school and send it certified. Legally the regular ed. teacher must be

present as well as an administrator who can authorize expenditures. Tell

them this and that you would like a LEGAL IEP ASAP. I'm glad you didn't

sign it. These folks must be pretty ignorant of the law.

Kristy,

You tell them doctors that I won't let them do this to you! I'll go there

myself and show them what for!!!!! You tell them that there is a very angry

woman in California that doesn't tolerate a**hole doctors very well.....

GGGGGGGRRRRRRR!

I'm so sorry you're having more problems, you really don't need this, but I

guess I don't have to tell you that, huh? Good luck hun, and just remember,

this can't happen forever, sometimes that is all that gets me through a day.

Have a great big cup of tea, and light some candles, and slip into a bathtub

with some soothing music playing. I recommend this three times a day as

needed for high stress levels. :) Hang in there, you know we are all

pulling for you.

Hi everyone!!

It's time for me to vent again b/c it's as the subject

heading says, " I'm so mad " .

Well, here's the deal. I called my ins co to find out what

the scoop was on going out of network even though I told my

dr not to do it b/c of my ins and the way that my ins is.

I have an HMO.

So the rep there was the one that told me that my dr got

the referral for me to go to Pain Management for

evaluation.

The Pain Management drs out here in my area are stupid when

it comes to the female problems and not only that but the

one that my dr wants me to see has admitted to me that she

can't help me.

Why the referral clerk from my ob's office didn't tell me

that they got the referral and that they were going to fax

the info over I don't know. She was supposed to tell me

all of this and I had to go and find out not only from the

ins co about the referral, but from the other dr themself

that my dr faxed over the information without telling me.

And then to top that all off the diagnosis for

pre-evaluation was wrong. It says " chronic pelvic pain "

and " vulvodynia " but that's wrong. It's wrong b/c this dr

is who is the Pain Management Specialist said that she

can't help me.

I really feel like telling my dr next week that I won't go.

We shall see what happens if and when they get the fax

over at the Pain Management clinic and that dr sees what

I'm trying to say.

Right now I'm so mad that I'm not sure what I'm going to

do. We shall see what happens b/c I may have to find a new

dr to take care of me.

come out there with you right about now. I'm getting the

feeling that my dr just isn't listening to the issue of my

pain anymore even though she will listen to everything else

I tell her. She was the one that I thought for sure would

not give me a hard time about the necessity of pain meds.

My last gyn didn't believe in giving pain meds. It was

nice to find a dr that would give pain meds without

problems (so I thought).

It was shocking to hear " I want them to evaluate you to see

if you really need pain meds. I'm afraid that you will get

addicted to this med (I take Lorcet as it works so well

with the Ponstel-an anti-inflammatory drug when I have real

bad flare ups). "

I will fight for my pain meds. What is the law out there

in CA when it comes to Pain Meds? Can you help me out?

I have a print out somewhere around here about hospital standards. People

kept complaining about not getting adequate pain management, so the

hospitals around here have a *mandatory* new regulation that they must have

patients rate their pain, and the staff themselves cannot make personal

judgments. I still have problems with my doc, and in fact, I sat down with

him, and said quite frankly, I don't care if I become addicted to this

substance, because my quality of life had gone to crap. I just wanted to

live out a somewhat normal life, and that this med helped me. I think it is

time for you to look for another doc. I just keep cruisin if they don't

help me in the way I need. Directly or indirectly, you HIRE them for their

services, why do we stay with doctors who treat us crappy? I dealt with

this guilt myself. Ya know, someone told me some very valuable advice

recently. It takes lots of muscle power to frown, but only one to hold up

your middle finger. :) Don't take it, you are perfectly capable, and an

intelligent woman. You know your body, and something is not being dealt

with. Scream and scream loud. There may be people out there that take meds

simply for the high, but at what expense to the people who really need it?

If you've found something that helps, go for it. Also, go to your state's

medical board website, there should be something about adequate pain

management, and print it out. A doctor has a responsibility to his

patients, and should not abandon them in their time of need. To me, this

sounds like abandonment, print out the pain thing, and bring it to your next

appointment. Search for things on the web, I'm sure you'll find something.

If all else fails, find another doc. You don't deserve this. Good luck

PS....Don't come to California, I hate it here! I'm moving back home to

Oregon as soon as I can!!!

well I can say it is up hear a doc has to have written permission in

triplick before he or she can give out medical information to any body at

all from the government to other doctors in the us you have more laws on

that so I would believe it is the same down there hope you do not mind me

popping in if so I not do it again I did not meant to interfere just to help

I feel for you. It is very stressfull to not be well and to be dealing with

all of this insurance crap. its all a business and that really gets to me.

I hope you have luck getting to the right person and get the help you need,

dont give up the fight!!!

I believe in every state it is illegal for one doctor to share your

confidential medical records with another doctor without your express written

permission (I could be wrong though.) It has to do with the patient

confidentiality laws. Permission forms must have

written onto it 1) The doctor you are giving records to 2) which doctors are

allowed to send your records, 3) exactly which records are to be given (i.e.

medical, mental health, substance abuse treatments, etc.), 4) the date signed

and how long the permission waiver

is good for, and 5) your signature.

If your doctor did share your medical records without your express consent, then

she did break the law. Be aware, though, that a lot of offices have taken to

having you sign a blanket consent form at the beginning of your treatment that

allows them to share records

with any other doctor they are referring you to. These are still only good for a

finite amount of time, and must periodically be renewed...but if you've

unknowingly signed one of these, and it is still within the specified amount of

time it is good for, there might

not be anything that you can do.

I agree with , however, there is also laws in some states that have

amended this, so that doctors could share information if there is a current

referral, I will check in to this for you Kristy, and let you know what I

find.

What an ordeal! Such a nightmare. You need to slap some of those people around hon, those Dr's sound useless. At least the pain management Dr was upfront and honest that she could not help you.

Hi again Aisha,

I see my dr again on March 8th for the biopsy unless they

can get me in sooner. I'm hoping soon as the nite was not

so kind to me painwise. It's eased up some now but not

enough that I probably won't have to use the heating pad.

We shall see what happens. And yes I'm glad that the Pain

dr told me straight up front about not helping me.

Now to convince my dr of that. Especially since I know

what's wrong with me.

That's how I handle it. I guess I show my combative attitude, as my past and present wives would consider it. I know I can get an attitude very quickly but I think I'm just looking out for myself and I don't let anyone deny me what it rightfully mine. If they try it, they will hear about it. And trust me,

I have the temper of an angry grizzly bear when I think I'm being screwed with. It's hard to keep my temper in check at times, but I just don't like being messed with. So there.

Sorry to be responding to a post from so long ago, but I am.

Kristy, you asked what the law was in California regarding getting pain

meds. Well, I no longer live in CA but I can tell you what I tell ANY

doc that gives me a hard time about pain meds.

The oath all doctors take when they become doctors begins, " DO NO HARM. "

I have quite vociferously reminded a couple doctors of their oath and

stated that by choosing to leave me in pain without doing anything about

it at that moment, they were doing me harm and I was not going to allow

them to harm me in that way.

I always got my meds, sometimes not enough of them, but I got them.

Sometimes I refused to see that doctor again and more than once I

refused to pay the final bill. I consider that I have FIRED that doctor

and that's the only real power I have over them. THEY WORK FOR US, WE DO

NOT WORK FOR THEM! Without us, the patients, doctors have nothing to do

and no money for not doing it.

That's how I handle it. I guess I show my combative attitude, as my past

and present wives would consider it. I know I can get an attitude very

quickly but I think I'm just looking out for myself and I don't let

Thanks for your note . I did get pain meds after that

e-mail I sent. My mother was with me at that appt. I have

another issue to deal with right now as to whether or not I

will have to fire this dr any way and find another dr. I

will keep everyone up to date.
